Ações autônomas do devedor

Resumo: A tese ora sustentada é a de que o suposto devedor não tem apenas os embargos à execução para defender-se; estes são apenas uma - e a mais eficiente - das ações de que pode valer-se para tanto. Ao lado dela, entretanto, não lhe podem ser negadas demandas autônomas, proponíveis antes da instauração do processo executivo, durante seu curso ou, principalmente, após seu encerramento; de modo especial nas hipóteses em que, em se tratando do processo de cognição, caberia ação rescisória contra a sentença {lato sensu) nele proferida, já que, não havendo julgamento no próprio processo de execução, não há sentença de mérito que possa ser objeto de rescisão (Cód. de Proc. Civil, art. 485, caput). Abstract: The thesis for now sustained is that the supposed debtor doesn’t just have the embargoes against the execution to defend himself; these are just a - and the most efficient - of the actions that he can use for so much. Beside it, however, they cannot be him denied autonomous demands, able of being proposed before the beginning of the executive process, during its course or, mainly, after its closing; in special way in the hypotheses in that, if the process was of cognition, action would fit to annul ( "ação rescisória") the sentence (lato sensu) in it pronounced, because, not existing judgement in the own execution process, merit sentence that can be annulled ( "rescindida") doesn’t exist (Civil Process Code, art. 485, caput).
