dc.description.abstractResumo: A presente dissertação visa a identificar os limites e o âmbito legítimo de incidência do dispositivo que incrimina atos de obstrução de justiça com relação a investigações envolvendo organizações criminosas. Como resultado da definição sucinta do crime de obstrução de justiça na Lei n.º 12.850/2013 - que prevê medidas e crimes relacionados a organizações criminosas -, os contornos da conduta incriminada não estão bem delimitados, o que, por sua vez, propicia os problemas de vagueza e amplitude do tipo penal. Isso leva a situações em que o exercício do direito de defesa - por investigados e/ou por seus defensores - pode ser enquadrado como atos de obstrução de justiça. Ambos esses problemas foram arguidos perante o Supremo Tribunal Federal, estando pendente a decisão da Corte a respeito da conformidade do tipo penal à Constituição. Considerando que a Corte muito provavelmente refutará a arguida inconstitucionalidade do dispositivo, é necessário analisar e definir contornos estritos a fim de limitar a amplitude do tipo penal, bem como identificar ações legítimas protegidas pelo direito de defesa. Alguns dos limites que podem ser indicados a partir da análise do dispositivo e de decisões judiciais são: (i) o crime de obstrução de justiça depende da existência de investigação criminal em curso, excluídas investigações privadas e/ou por parte de órgãos públicos não relacionados com a atividade de persecução penal; (ii) o crime pressupõe resultados de efetiva cessação, atraso ou dificuldades como consequências das condutas delituosas; (iii) o direito de defesa exclui a natureza delituosa de atos de recusa de cooperação com investigações por meio de condutas omissivas; (iv) o direito de defesa não acoberta investigados que atuem diretamente contra atos de investigação pendentes, iminentes e/ou em curso, como com ameaças contra testemunhas, destruição de provas prestes a serem apreendidas pelas autoridades ou atos já proibidos por outros dispositivos criminais; (v) o direito de defesa técnica exercido por intermédio de defensor exclui a natureza delituosa de atos situados nos contornos éticos e legais da advocacia; (vi) o direito de defesa técnica não protege advogados ou defensores públicos que ajam fora ou contra os limites profissionais a fim de voluntariamente prejudicar os atos de investigação. A identificação desses e outros limites à incidência do tipo de obstrução de justiça reduz a vagueza e amplitude da norma incriminadora e atenua seus conflitos com o direito de defesa. Contudo, esses limites porventura não servirão para resolver todos os possíveis casos complexos, ficando a cargo das cortes a diferenciação entre atos legítimos de defesa e atos de obstrução de justiça.pt_BR
dc.description.abstractAbstract: The present dissertation seeks to identify the limits and the legitimate scope of incidence of the statute that criminalizes acts of obstruction of justice against investigations involving criminal organizations. As a result of the succinct definition of the crime of obstruction of justice set by Law No. 12.850/2013 - which defines legal measures and crimes related to criminal organizations -, the outlines of the criminal conduct are not well set, which, in turn, propitiates the problems of vagueness and overbreadth of the definition. This leads to the existence of situations in which the exercise of the right of defense - by the investigated parties and/or their counselors - may be viewed as acts of obstructions of justice. Both these problems have been argued before the Supreme Federal Court, pending the Court's ruling on the constitutionality of the wording of the legal definition. Considering the Court will most likely refute the argued unconstitutionality of the statute, it is necessary to analyze and set strict boundaries to limit the offense's overbreadth, as well as to identify legitimate actions protected by the right of defense. A few of the limits that can be identified through the analysis of the statute and case law are: (i) the obstruction of justice offense depends on the existence of a pending criminal investigation, excluded investigations by private parties and/or by government agencies not related to criminal prosecution; (ii) the offense presupposes results of effective cessation, delay or difficulties as the consequences of the criminal conducts; (iii) the right of defense excludes the criminal nature of acts of refusing to cooperate with the investigations through omissive conducts; (iv) the right of defense does not protect investigated parties that take direct action against pending, imminent and/or occurring acts of investigation, such as threats against witnesses, destruction of evidence soon to be apprehended by the authorities or acts already prohibited by other criminal statutes; (v) the right of technical defense by way of legal counsel excludes the criminal nature of acts within the ethical and legal boundaries of advocacy; (vi) the right of technical defense does not protect lawyers and/or public defendants that act outside and/or against the boundaries of their profession to willingly hinder acts of investigation. The identification of these and other limits to the incidence of the obstruction of justice statute reduce the vagueness and overbreadth of the criminalizing norm and mitigate its conflicts with the right of defense. However, these limits may not serve to resolve all possible complex cases, leaving it up to the courts to differentiate legitimate acts of defense from criminal acts of obstruction of justice.pt_BR
