Trabalho docente na educação profissional e tecnológica de nível médio no Paraná : análise das políticas de provimento e da contratação da força de trabalho na Secretaria Estadual de Educação e no Instituto Federal do Paraná a partir de 2011

Resumo: Esta tese teve como objeto de estudo a precarização do trabalho docente, com enfoque na hipótese de dupla precariedade das formas de contratação e das normas de provimento de professores para a Educação Profissional e Tecnológica de Nível Médio (EPTNM), na Rede Estadual de Educação do Paraná (SEED/PR) e no Instituto Federal do Paraná (IFPR), vigentes de 2011 a 2021. A questão emerge com a criação do Programa Nacional de Acesso ao Ensino Técnico e Emprego (PRONATEC) em 2011; esse assumiria o fomento e o financiamento da expansão da EPT no país, todavia, representou o espraiamento do setor privado sobre os recursos destinados à EPTNM. O programa previu a contratação de professores como bolsistas, por meio de vínculos contratuais, sem regulamentação prevista pela CLT, ou pelos regimes próprios conhecidos. Essa situação anuncia a precarização que se poderia entrever nas relações contratuais da força de trabalho, somada a não exigência de formação em cursos de licenciatura em nível superior para docência na EPTNM, lacuna existente no Art. 62 em relação ao inciso IV do Art. 61 da LDB (BRASIL, 1996). O problema de pesquisa consistiu em identificar e analisar como a precariedade do trabalho de professores da EPTNM está presente nos contratos e nas formas de provimentos, na SEED/PR e no IFPR, de 2011 a 2021, tendo como objetivo geral analisar os dispositivos jurídicos que tratam das condições de trabalho enfrentadas pelos docentes de instituições públicas da EPTNM paranaense, a partir de elementos de gestão, formas de provimento e do corpus político que os fundamentam, a fim de identificar os problemas relacionados aos docentes dessa modalidade de ensino. A pesquisa valeu-se de análise bibliográfica de caráter documental, de dados qualitativos e quantitativos, com mapeamento das ofertas de EPTNM da SEED/PR e do IFPR; análise das legislações pertinentes à carreira, provimento e contratos de trabalho dos professores; inventário dos editais de processos seletivos simplificados e de concursos; informações sobre a organização da classe docente presente em sites de associações e sindicatos. Analisamos o conteúdo dessas informações, extraindo as categorias da dupla precarização da contratualidade e das formas de provimento de professores à EPTNM nas duas redes. As categorias encontradas dizem respeito à mediação do Estado, a partir da compreensão de trabalho, emprego e educação, no sistema capitalista; à seleção e contratação, demonstrando ausência de concursos na SEED/PR e ampliação dos vínculos temporários em ambas as redes, com editais diversificados de seleção; à qualificação e formação, com ausência de formação pedagógica e exigência dessa; à jornada e organização do trabalho, com ampliação do tempo em sala, desconsiderando a especificidade da EPTNM, seus estágios e práticas; e ao salário com depreciação dos valores pagos aos docentes. A dupla precarização do trabalho docente na EPTNM se confirmou, em relação aos docentes da educação básica, dependente da movimentação política dos trabalhadores na proposição de mudanças estruturais acerca da compreensão e função social da EPTNM. Abstract: This thesis had as object of study the precariousness of teaching work, focusing on the hypothesis of double precariousness of the forms of hiring and the rules of provision of teachers for Professional and Technological Education of Middle Level (EPTNM), in the Paraná State Education Network (SEED/PR) and in the Federal Institute of Paraná (IFPR), from 2011-2021. The issue emerges with the creation of the National Program for Access to Technical Education and Employment (PRONATEC) in 2011; which would assume the promotion and financing of the expansion of EPT at country level, however, represented the spread of the private sector under the resources destinated to EPTNM. The program foresaw the hiring of teachers as scholarship holders, through contractual bonds, without regulations provided by the CLT, or by the known own regimes. This situation announces the precariousness that could be seen in the contractual relations of the workforce, added to the absence of formative requirement in high level teaching to teach in the EPTNM, a gap in Art. 62 in relation to item IV of Art. 61 of the LDB (BRASIL, 1996). The research problem consisted of identifying and analyzing how the precariousness of the work of EPTNM teachers is present in the contracts and forms of provision, in SEED/PR and IFPR, from 2011-2021, having as general objective to analyze the legal provisions about the working conditions faced by teachers of public institutions of EPTNM Paraná, from management elements, forms of provision and the political corpus that underpins them, in order to identify the problems related to teachers of this type of teaching. The research used bibliographic analysis of documentary character, qualitative and quantitative data, mapping the EPTNM offers of SEED/PR and IFPR; analysis of legislation relevant to the career, provision and teachers’ employment contracts; inventory of the public notices of simplified selection processes and tenders; information about the organization of the teaching class located in sites of associations and unions. We analyzed the content of this information, extracting the categories of double precariousness of contractuality and forms of provision of teachers to EPTNM in both networks. The categories found are about the State mediation, based on the understanding of work, employment and education, in the capitalist system; the selection and hiring, which demonstrate absence of competitions in SEED/PR and expansion of temporary links in both networks, with diversified public notices of selection; the qualification and training with absence of pedagogical training and requirement of it; the journey and organization of work with amplification of the time spent in the classroom, disregarding the specificity of the EPTNM, its stages and practices; and salary with depreciation of the amounts paid to teachers. Therefore, the double precariousness of EPTNM teachers was confirmed in comparison to basic education teachers, and depends on the political action of workers in proposing structural changes about the understanding and social function of the EPTNM.
