dc.description.abstractResumo: (Re)pensar o processo de execução exige, antes de tudo, um necessário reconhecimento da opção do legislador em renega-lo a um plano, senão inferior, pelo menos secundario em relação aos demais que compõem o código de processo civil. Quando a espécie executiva em analise é a por quantia certa contra devedor solvente (execução de créditos), essa percepção aflora com muito mais nitidez. O presente trabalho tem, justamente, essa preocupação. Ao mesmo tempo que procura descortinar a verdadeira face da jurisdição, que não só a simplória "missão" de dizer o direito ao caso concreto, procura encontrar meios para dar concretude às decisões judiciais que condenam o Réu/devedor ao pagamento da soma, resgatando sua importância para a tutela dos direitos. Com base neste desiderato, procurou-se, a partir de um relato sobre a formação de Estado Moderno enquanto monopolizador da administração da justiça, desenvolver um raciocínio capaz de enaltecer a jurisdição como dever estatal e voltada para a consecução de um processo civil de resultados, entendido como aquele capaz de entregar à parte o seu direito material violado e devidamente reconhecido pelo poder judiciário, em tempo razoável. Partindo-se de estudos desenvolvidos, principalmente, acerca da execução da obrigação de fazer e não fazer, buscou-se apontar também, a necessidade de aparelhar a execução por créditos de mecanismos processuais eficazes e aptos a realizarem, no mundo dos fatos, o direito do credor. Sempre tendo como escopo que a verdadeira efetividade do processo é alcançada com a pronta entrega do bem da vida à parte, vislumbrou-se a necessidade de reconhecer maiores poderes ao juiz, fornecendo-lhe a possibilidade de, mesmo na seara executiva por créditos, ordenar ao Réu-devedor o cumprimento da obrigação (pagamento ao credor), sob pena de multa por dia de atraso. Tendo como suporte as medidas executivas utilizads pelo direito inglês, mas, sem olvidar a realidade nacional, inovou-se, dentro da perspectiva da efetividade prometida, inclusive, em nível constitucional, com a fecunda possibilidade de se fomentar o órgão judiciário de "força"suficiente para compelir o obrigado a cumprir a decisão. O objetivo, pois, é fazer com que o devedor escolha pelo cumprimento da obrigação pecuniária não só por espontaneidade, mas por ser a melhor "opção". Para isso, discutiu-se a atividade desenvolvida pelos sujeitos da relação jurídica de direito processual e conclui-se que toda incumbência pela efetividade da execução recaia em maior grau, ou até mesmo na sua totalidade, sobre o Autor/credor. O Estado mantinha-se, não obstante a promessa de entrega da prestação jurisdicional, numa posição mansa e pacifica na assistência de uma luta desigual em que o titular do direito reconhecido judicialmente (sentença transitada em julgado) era a todo instante levado a engodo, sem que o responsável/obrigado sofresse qualquer espécie de sanção. Nesse diapasão, projetou-se uma maior participação por parte do Estado-juiz, já que devedor da tutela jurisdicional, culminada em sansão ao Réu/devedor em resposta ao desprezo que empregara à execução. Conclui-se, então que: a)há a possibilidade da imposição da multa pecuniária como forma de resgatar o prestigio da decisão judicial; b) a ausência de patrimônio torna a execução insolúvel, pois a multa ou até mesmo a prisão, seria ineficaz e; c)nos casos de "riqueza aparente", sem que o Réu/devedor consiga esclarecer a flagrante contradição existente entre a "ausência" de patrimônio e a condição social ostentada e, se devidamente advertido a indicar bens passiveis de constrição judicial, mantiver-se indiferente, poder-se-ia cogitar na restrição da sua liberdade como forma de inibir o desrespeito ao poder legalmente instituído.pt_BR
dc.description.abstractAbstract: [Re]thinking the enforcement process demands, beforehand, a necessary recognizing of the legislator's option in keeping it on a platform, if not inferior, at least secondary when relating to the others belonged to de civil procedure code. When we are talking about enforcement of earnings this perception becomes much more clear. That's exactly the aim of the present work. At the same time that it tries to uncover the real face of the jurisdiction, showing that it is not only a simple mission of saying the law in face of the real facts, it tries to find ways to accomplish the judicial decisions that obligates the debtor to pay a amount of money, rescuing the importance of this right. Based on this, we tried, from the idea of the formation of the Modem State as having the monopoly of the justice administration, to develop a rationale able to enhance the jurisdiction as a state obligation facing the accomplishment of a civil procedure law of results, understood as the one able to give the part his material law violated and recognized by the judiciary in a reasonable time. Beginning from studies developed, mainly about the enforcement of the obligation of doing or not doing, we tried to point out, too, the necessity of giving the enforcement for credits efficient procedure mechanisms, able to realize, in the world of facts, the creditor rights. Always having in mind that the real procedure effectiveness is reached with handling in time the life goods, we saw the necessity to recognize the need to give more power to the judge giving him the possibility to, even in the credits enforcement, order the debtor to accomplish the obligation (paying the creditor), under the sanction of fee per late day. Under the support of the enforcement measures used by the British Law, but, without forgetting the Brazilian reality, the essay renewed, from the perspective of the promised effectiveness, even at the constitutional level, the fecund possibility to foment the judiciary of sufficient power to compel the debtor to accomplish the decision. The aim, though, is to make the debtor to choose for the accomplishment of the pecuniary obligation not only for spontaneity, but for being the better 'option'. In order to get to this conclusion we discussed the activity developed by the subjects of the judicial relation of procedure law and concluded that the obligation of the enforcement effectiveness belongs, in a higher degree, or even in its totality, to the creditor. The State used to stay, nevertheless the promise to deliver a judicial answer, in a pacific and steady position assisting an unfair fight where the owner of a judicially recognized right was always forgotten, and at the same time the debtor did not suffer any kind of sanction. Thinking on this we project a bigger participation of the State, since its the owner of the jurisdictional power, translated in sanction to the debtor in answer to the despite employed in the enforcement procedure. We conclude so that: a) It is possible to impose the payment of fee to ransom prestige of the judicial decision; b) the absence of the debtor assets makes the enforcement impossible once that the fine or even the imprisonment would be inefficacious; c) in the cases of apparent richness when the debtor is not able to explain the flagrant contradiction between the absence of assets and the apparent social condition and, if warned to indicate assets able to be seized, shows indifference, it is possible to think in his freedom restriction as a form to inhibit the contempt to the Legal Order.pt_BR
