dc.description.abstract | Resumo: A desinformação, comumente chamada de fake news, é fenômeno antigo que com o advento e a popularização da internet ganhou notoriedade e projeção mundial, especialmente desde as eleições presidenciais estadunidenses de 2016. No âmbito eleitoral brasileiro foi observada uma enxurrada de notícias falsas nas eleições de 2018, o que fez com que a Justiça Eleitoral voltasse suas atenções para a prevenção e o combate à sua disseminação. Diante disso, esta pesquisa investiga a interferência que a desinformação pode causar no pleito eleitoral e quais as respostas que podem ser adotadas. Para tanto por meio da pesquisa bibliográfica e jurisprudencial no âmbito dos Tribunais Regionais Eleitorais e do Tribunal Superior Eleitoral, acerca da (in)existência de vínculo entre a desinformação e a democracia – a partir dos institutos da liberdade de voto, do direito à informação e da liberdade de informação – e os atuais mecanismos jurídicos para seu combate. Em conclusão, verificou-se que a liberdade de voto, o direito à informação e a liberdade de informação são instrumentos fundamentais da democracia e que a divulgação irrefreada da desinformação coloca em xeque o seu exercício, pois macula a formação da vontade do eleitorado e deslegitima a delegação do poder. Diante disso, mostra-se necessária a adoção de medidas de conscientização – por meio da educação digital –, de prevenção – por meio da identificação das fontes criadoras e o seu desmantelamento, assim como do combate à atividade inautêntica nas redes sociais –, e de combate – por meio da remoção de conteúdo via judicial e da concessão de direito de resposta e pelo cumprimento das políticas de uso das redes sociais, assim como da interrupção, por via da jurisdição, da transmissão de mensagens pelos aplicativos de mensageria. Dessa forma, a desinformação, como um fenômeno com potencialidade de colocar em risco a genuinidade da democracia deve ser levada a sério, combatida e reprimida. | pt_BR |
dc.description.abstract | Abstract: Disinformation, commonly known as fake news, is an old phenomenon that with the advent and rise of the internet has gained notoriety and worldwide projection, especially since the 2016 US presidential elections. In the Brazilian electoral context, we experienced a flood of fake news in the 2018 elections, which made the Electoral Justice turn its attention to preventing and combating its spread. With it in mind, it is questioned the interference that disinformation can cause in the electoral process and what responses can be adopted. From the bibliographic and jurisprudential, in the scope of the regional electoral courts and the Superior Electoral Court, research it seeks to identify the (in)existence of a link between disinformation and democracy - from the institutes of electoral authenticity, freedom of vote, right to information and freedom of information – and the current legal mechanisms for combating them. Thus, it was found that electoral authenticity, freedom to vote, the right to information and freedom of information are fundamental instruments of democracy and that the unrestrained dissemination of disinformation puts its exercise in jeopardy, as it taints the formation of the will of the electorate and delegitimize the delegation of power. Thus, it is necessary to adopt measures to raise awareness - through digital education -, prevention - through the identification of creative sources and their dismantling, as well as the fight against inauthentic activity on social media -, and combat - through the removal of content through the courts and compliance with social media usage policies, as well as the interruption, via court decision, of the transmission of messages through messaging applications. In this way, disinformation, as a phenomenon with the potential to jeopardize the genuineness of democracy and electoral authenticity, must be taken seriously, fought and repressed. | pt_BR |
