Dilemas do direito penal : reflexão a partir da hermeneutica do sistema

Resumo: A presente tese propõe um diálogo entre a filosofia e o direito penal. As assertivas lançadas como a base do trabalho são o resultado da reflexão filosófica do autor, que denotam sua angústia face o direito e a vida, e à vida do direito. A linha temática não é aleatória, à medida que pretende passar do problema ao dilema, perquirindo-se, desta forma, o problema pelo que se julga serem seus condicionantes e o dilema, como decorrência natural do problema que engendra a formação, a estrutura, a operacionalidade e a expressão do discurso da ciência jurídica em geral e do direito penal, em especial. Daí a presente tese passa do estudo do Sistema e da Hermenêutica ao que se denomina crise da ciência criminal, analisa seus sintomas, pontua o diálogo com o direito em crise, e, retoma o discurso da filosofia para falar do direito penal, apontando algumas faces do dilema. A fluência do diálogo está, justamente, na tentativa intermitente de se não partir nem da filosofia nem do direito, isoladamente. O que se pretende, é revelar a angústia do direito face à impotência dos seus meios, a ilusão da filosofia face à sacralização de seus argumentos, e, por fim, apontar, ainda que não completamente, o que é possível para o direito - e para o direito penal - em face dos conflitos da vida, e o que é possível para a filosofia, face a angustia da vida, num diálogo, que identificando o problema, constata o dilema. Abstract: This present thesis has the purpose of creating a dialog between philosophy and criminal law. The allegations used as the basis of this work are the results of the author's philosophical reflections that shows his anguish facing life and law as well as facing the life of the law A pre-established line was set since the author intents to progress from problem to dilemma, questioning the problem and finding its conditions, and the dilemma as natural consequence from the problem that makes its formation, structure, operational ways and the expression of the speech from the science of law in general, and specifically from the criminal law. For this reason this theses goes from a study of the system and the hermeneutic to what is called the crisis of the criminal science, analyses its symptoms, shows the dialog with the law in crisis, and takes back the speech of philosophy to talk about criminal law, showing some sides of the dilemma. The fluency of speech, is precisely in the intermittent attempt to avoid taking neither the philosophy nor the law as isolated basis. The intention is to reveal the anguish of law facing the powerlessness of its means, the illusion of the sanctity of the terms of philosophy, and finally to point out what is possible for the law - and the criminal law - facing the conflicts of life, and what is possible for philosophy facing the anguish of life, in a dialog that identifying the problem, establishes the dilemma.
