Vivissicação e a lei 11.794/2008 : uma crítica animalista ao uso de animais no ensino brasileiro

Resumo : O presente trabalho tem como objetivo principal trazer à discussão a utilização de animais na docência. Para tanto, foi necessária a apresentação suscinta de visões filosóficas meramente para situar o leitor na discussão do tema, haja vista que o foco principal é demonstrar que há meios alternativos que não necessitam da utilização da vivissecção. Existem tecnologias que são capazes de possibilitar aos animais a real libertação desse tipo de crueldade, uma vez que estes ainda são vistos, infelizmente, como seres inferiores aos humanos. Os teóricos utilizados com destaque são Descartes, Bentham, Kant, Singer, Regan e Francione. O método utilizado no presente estudo é o dedutivo-indutivo, utilizando-se como metodologia a pesquisa bibliográfica, análise de leis, doutrinas e jurisprudência, objetivando uma pesquisa qualitativa. O marco teórico-temporal, propriamente dito é a Lei n. 11.794/2008, conhecida como Lei Arouca. Cabe ressaltar que se fez necessária a utilização de teóricos para esclarecer melhor o leitor sobre a vivissecção no ensino, não fazendo deles efetivamente um marco teórico em si para o presente estudo, o qual está limitado a tratar mais especificamente sobre a utilização do animal não humano no ensino. Não será, portanto, abordado o uso do animal na experimentação para fins científico, de testes com intuito farmacêuticos, de fabricação industrial de cosméticos dentre outras tantas funções s quais se tem submetido os animais não humanos, ainda que pese sobre estes a chancela da referida lei. Abstract: The main purpose of this study is to bring to discussion the use of animals in education. Therefore, it was necessary the brief presentation of philosophical views merely to situate the reader in the discussion of the theme, ensuring that the main focus is to demonstrate that there are alternative methods that do not require the use of vivisection. Some technologies are capable of enabling animals to be truly liberated from this kind of cruelty since they are still seen, unfortunately, as beings inferior to humans. The prominent theorists used are Descartes, Bentham, Kant, Singer, Regan, and Francione. The method used in this study is deductive-inductive, using as methodology the bibliographic research, analysis of laws, doctrines, and jurisprudence, aiming at qualitative research. The theoretical-temporal framework, properly speaking, is the Law n. 11.794/2008, known as the Arouca Law. It is worth mentioning that it was necessary to use theorists to better clarify the reader about vivisection in teaching, not making them effectively a theoretical framework in themselves for the present study. It is limited to dealing more specifically with the use of non-human animals in education, not being, therefore, addressed the issue of cruelty and mistreatment, for example, in other areas such as in experimentation for testing on animals for pharmaceutical purposes, industrial manufacturing of cosmetics, among many other functions to which non-human animals have been subjected, even though the law also deals with these themes.
