A (im)possibilidade da expansão de poderes do Supremo Tribunal Federal via recurso extraordinário

Resumo : O presente artigo pretende estudar a expansão de poderes do Supremo Tribunal Federal (STF), com foco no controle difuso de constitucionalidade; a chamada abstrativação do controle difuso via art. 52, X e sua propalada muttação constitucional, que teria aproximado o controle concreto e o controle abstrato de constitucionalidade. Para tanto, é realizado um panorama sobre o sistema de controle de constitucionalidade brasileiro com enfoque na expansão de poderes do judiciário, utilizando-se de autores como Oscar Vilhena de Vieira e o conceito de "supremocracia", bem como estudos mais recentes sobre o fenômeno, como os levantamentos empíricos realizados pelo professor Diego Werneck. Tenta-se definir, de forma breve, os parâmetros institucionais, bem como aqueles criados pelo próprio STF, que tornaram o papel do Tribunal predominante. Depois, o enfoque passa a ser no controle difuso de constitucionalidade. Ao final, são feitos estudos com decisões tomadas em sede de Recurso Extraordinário pelo Supremo Tribunal Federal, para avaliar como a suposta mutação estava - ou não - sendo expressas em decisões posteriores. A escolha das decisões teve como parâmetro a delimitação temporal em 2018, para possibilitar a análise de decisões tomadas pelo Plenário posteriores às decisões das ADIs 3406 e 3470; que trataram expressamente sobre a suposta mutação constitucional do art. 52, X. Com as decisões, destaca-se também, a relevância dos assuntos debatidos em sede de Recurso, para demonstrar a importância que a expansão dos efeitos traria em todo o ordenamento jurídico. Absrtract: This article intends to study the expansion of the Brazilian Supreme Court's power, by focusing on the diffuse control of constitutionality; the called abstractiveness of the diffuse control by way of article 52, X, and its much-vaunted change in the interpretation which would have approximated the diffuse control and the abstract control of constitutionality. Therefore, it is performed an overview about the Brazilian system of control of constitutionality with focus on the expanded powers of the judiciary, by using authors as Oscar Vilhena Vieira and the concept of "supremedemocracy", as well as more recent studies about the phenomena, such as the empiric survey conducted by the Professor Daniel Werneck. It is attempted to briefly define the institutional parameters including the ones created by the Brazilian Supreme Court, which have made the roll of the predominant court. Then, the focus becomes the diffuse control of constitutionality. In the end, studies are made with decisions taken in the context of an Extraordinary Appeal by the Supreme Federal Court, to assess how the alleged change of interpretation was - or not - expressed in subsequent decisions. The choice of the decisions was based on the temporal delimitation in 2018, to enable the analysis of decisions taken by the Plenary after the decisions of the direct action for the declaration of unconstitutionality nº 3406 and nº 3470; which dealt expressly with the aleeged change of interpretation in article52, X. With the decisions, it is also worth highlighting the relevance of the issues discussed in the Appeal, to demonstrate the importance that the expansion of the effects would bring in the entire legal system,
