A investigação defensiva no Brasil : novas tendências e desafios para a atuação da defesa na fase preliminar

Resumo : O presente trabalho estuda o tema da advocacia defensiva, o qual ainda é pouco debatido na doutrina brasileira e, da mesma forma, é uma prática pouco efetivada. Ao se verificar que o Brasil adota o inquérito policial como modelo de investigação, muitos relacionam a fase preliminar ao modelo inquisitivo, e, por isso, relegam o debate sobre a participação da defesa nessa fase. Entretanto, as novas reformas infraconstitucionais no processo penal, a tendência à adoção de figuras negociais e a ampliação da importância da fase investigativa denunciam a necessidade de um maior protagonismo da advocacia já na fase preliminar. Alguns países têm adotado o que vem sendo chamado de investigação defensiva, destacando-se entre esses, o sistema italiano e o norte-americano, os quais revelam interessantes práticas envolvendo a atuação do defensor antes da instauração do processo penal. De outro lado, no Brasil, o espaço de atuação da defesa na fase pré-processual penal ainda é muito tímido, seja pelo fato de adotarmos o sistema do inquérito policial, seja pela falta de uma cultura que enxergue com bons olhos e com a devida importância a atuação do defensor. Em meio às críticas do sistema processual brasileiro, os entusiastas sonham que o sistema acusatório seja implantado, e, por tal razão, não vislumbram as possibilidades existentes em nossa realidade processual penal, a qual já consagrou a ampla defesa comodireito fundamental no processo e no procedimento administrativo. O que interessa ao presente trabalho, assim, é a análise acerca dos limites e especialmente, das possibilidades e contribuições de uma atuação mais ativa da defesa na fase preliminar, pois cada vez mais fica evidente a indispensabilidade da atuação do advogado antes que o processo se inicie. obstante a criação de algumas normas nos últimos anos sobre o tema, será que nosso sistema processual penal atual comporta, de fato, uma advocacia defensiva? Seria nossa realidade processual penal compatível com a investigação direta pela defesa? Partindo de uma análise constitucional, poderia a atuação da defesa na investigação ser considerada um direito fundamental? Quais são as finalidades eas possibilidades da investigação defensiva durante as fases da persecução penal? O que é preciso para a sua efetivação e como isso pode contribuir para um processo penal mais participativo e efetivo? São esses alguns dos principais questionamentos que nortearão o desenvolvimento desta monografia. Ademais, a abordagem do tema será realizada por meio de pesquisa bibliográfica dos principais escritos publicados. Abstract: The present work studies the Brazilian legal doctrines which still are hardly discuss the subject of preliminary criminal defense, and, consequently, is hardly practiced by counselors. After noticing Brazil’s adoption of police inquiry as an investigation model, many correlate it to the preliminary step of the inquisitive model, and, because of it, relegatethe debate about the agency of the defenders in that step of the prosecution. However, the new infra-constitutional reforms on criminal procedural law, the trend in adopting negotiation options and the increased importance of the investigative step announce the need for a larger prominence of the defense by that preliminary step. Some countries have been adopting a, so called, defensive investigation, standing out amongst those, the Italian and northAmerican systems, those which reveal interesting practices about the legal action of the defenders before the criminal procedure itself. In another hand, the Brazilian proceedings’ room is still shy for a proper defensive criminal investigation, either because of the adopted police inquiry system, or be it by the lack of a culture that both welcomes and properly ascertains the importance of the defender’s role in the process. In the midst of critiques on Brazilian criminal procedural system, enthusiasts hope an accusatory system is installed, and, therefore, do not shine light over the current possibilities of our legal scenario, which has already crowned the ample defense as a fundamental right in both legal and administrative proceedings. The subject explored by this paper was the analysis on the boundaries and, especially, on the possibilities and contributions of a more active role of the preliminary defense, because it gets clearer again and again how essential is the role of an attorney on the administrative proceedings before the start of a criminal lawsuit. Despite the instating of new rules in the last few years on the subject, is it feasible for our prosecutorial system to actually sustain preliminary criminal defense? Would our prosecutorial reality be compatible with direct defensive investigation? From a constitutional analysis standpoint, could the defense’s role in the investigation step be seen as a fundamental right? What would be the objectives and possibilities of the criminal defense during the steps in the prosecution process? What would take to effectuate it and how can it contribute to a criminal prosecution more participatory and democratic? These are some of the moot points guiding the development of this monograph. In addition, the theme will be approached through bibliographic research of the main published writings.
