Resumo : O presente trabalho tem como objetivo analisar como o comportamento processual das partes pode ser utilizado na formação do convencimento do juiz. A análise da temática perpassará, inicialmente, por breves questões atinentes ao processo civil e a prova, enfatizando a necessidade de observar o processo sob a ótica constitucional, garantindo a tutela dos direitos, para que o processo cumpra sua finalidade. Para tanto, analisam-se quais são os fins da prova e a sua relação com a verdade, bem como a relação da atividade cognitiva do juiz com a prova, ressaltando que por meio dos poderes a ele atribuídos, pode o juiz utilizar o comportamento processual da parte para propiciar uma tutela jurisdicional mais
justa. Assim, realizou-se breve análise do comportamento processual da parte, destacando que ele é um fato jurídico que importa para o processo, vez que trará impactos no desenrolar da demanda. Em seguida, destaca-se que o comportamento das partes deve estar em harmonia com os princípios fundamentais do processo, em vista da importância que Código deu ao comportamento ético dos personagens do processo. Por fim, será demonstrado que o comportamento das partes pode servir para a formação da convicção judicial como argumento de prova, ou seja, como fato indiciário. This paper aims to analyze how the procedural behavior of the parties can be used in the formation of the judge's conviction. The analysis of the subject matter will initially go through brief questions related to the civil suit and the evidence, emphasizing the need to observe the process from the constitutional point of view, guaranteeing the protection of rights, so that the process fulfills its purpose. To this end, the purposes of the evidence and its relationship with the truth are analyzed, as well as the relationship between the judge's cognitive activity and the evidence, emphasizing that through the powers attributed to him, the judge can use the procedural behavior of the party to provide a fairer judicial protection. Thus, a brief analysis of the procedural behavior of the party was made, emphasizing that it is a legal fact that matters for the process, since it will have impacts on the course of the demand. Next, it is emphasized that the behavior of the parties must be in harmony with the fundamental principles of the process, in view of the importance that the Code gave to the ethical behavior of the characters of the process. Finally, it will be demonstrated that the behavior of the parties can serve for the formation of judicial conviction as an argument of evidence, i.e., as an indicative fact.
