Tutela de urgência no processo arbitral brasileiro e a conformação da figura do árbitro de emergência

Resumo : Sem sombra de dúvida, a arbitragem, como meio de resolução de disputas e de tutela a direitos, enfrenta tensões entre as exigências decorrentes do devido processo legal e a tempestividade da prestação final. A técnica de tutelas provisórias, a se destacar as medidas de urgência, é, nesse sentido, a principal resposta a oferecer a esperada e efetiva tutela ao direito material, seja para assegurá-lo, seja para já satisfazê-lo diante de perigo de dano ou risco ao resultado útil do processo. Este trabalho, portanto, visa examinar como se estruturam essas tutelas de urgência no processo arbitral brasileiro, em especial a distribuição de poderes entre o árbitro, juízo escolhido pelas partes, e as cortes estatais. Mais do que isso, tendo por premissa que a arbitragem é solução privada e sujeita a regime de mercado, pretende-se analisar a viabilidade, estrutura e pertinência de uma das recentes inovações trazidas pelas instituições arbitrais, buscando oferecer novas ferramentas e, assim, enfrentar problemas e ineficiências: o árbitro de emergência. Abstract: Without a doubt, commercial arbitration as a dispute resolution method providing for rights protection faces some tensions concerning the procedural requirements that derive from due process and the timeliness of a final decision. In this sense, interim protection of rights through provisional measures is an important procedural technique in order to secure and offer a rightful and effective protection, presenting both protective and satisfactory measures when facing situations of risk of loss or injury to the useful outcome of the lawsuit. Therefore, this paper sought to understand how those provisional measures are structured under theBrazilian Arbitration Act, specially the distribution of the power to grant interlocutory relief between the arbitrator, as the authority chosen by the parties, and national courts. Beyond that, considering that arbitration is a private dispute resolution method subjected to a market regime, this paper also intends to exam the feasibility, structure and practical relevance of one of the recent innovations brought by arbitral institutions: the emergency arbitrator.
