(Des)coordenação governamental : federalismo brasileiro frente à pandemia

Resumo : O presente artigo trata das ferramentas dispostas pelo arranjo do federalismo brasileiro para o enfrentamento à pandemia, com recorte delimitado ao âmbito da saúde e à coordenação horizontal entre estados. Para tanto, a primeira parte do artigo científico enfrenta as disputas judiciais pelo poder de decidir, travadas no Supremo Tribunal Federal nas figuras da ADPF 672 e das ADI’s 6.341 e 6.343, sendo apresentadas suas implicações fáticas e peculiaridades quanto ao entendimento até então enunciado pela Corte. A segunda, por sua vez, examina a estrutura federativa do Sistema Único de Saúde, quais mecanismos de articulação e atuação conjunta oferece e como tem sido o (sub)aproveitamento do governo federal em sua gestão. Na terceira parte, por fim, expõe-se a atuação dos estados, sendo investigados a postura, ainda que assimétrica, de resistência ao governo federal e o estabelecimento, ou não, de organização interestadual, especificamente por meio de consórcios. Chegou-se à conclusão de que, em termos de (des)coordenação governamental, tanto a desconsideração dos instrumentos de monitoramento compartilhado e formulação de estratégias conjuntas do SUS, quanto a atuação pulverizada dos estados brasileiros, somados à experiência das mazelas e perdas decorrentes dos níveis de contágio descontrolados da 1ª onda, podem ser fatores que venham a compelir os entes à articulação, expressa em uma atuação de Consórcios mais explícita na 2ª onda de Covid19. Abstract: This article deals with the tools available in the Brazilian federalism arrangement to face the pandemic, with a limited focus on health and horizontal coordination among states. To this end, the first part of the paper discusses the legal disputes over the power to decide, which took place in the Federal Supreme Court in ADPF 672 and ADIs 6.341 and 6.343, and presents the factual implications and peculiarities of the position taken by the Court until then. The second, in turn, examines the federative structure of the Unified Health System, which mechanisms of articulation and joint action it offers, and how the federal government has (under)utilized it in its management. In the third part, finally, the performance of the states is exposed, investigating the posture, even if asymmetric, of resistance to the federal government and the establishment, or not, of interstate organization, specifically through consortiums. The conclusion was reached that, in terms of governmental (dis)coordination, both the disregard of instruments for shared monitoring and formulation of joint SUS strategies, and the pulverized performance of Brazilian states, added to the experience of the woes and losses resulting from the uncontrolled contagion levels of the 1st wave, can be factors that will compel the entities to articulate, expressed in a more explicit Consortium performance in the 2nd wave of Covid-19
