Resumo: A presente tese pretende discutir o fundamento lógico do político através da interlocução entre Direito, Filosofia, Psicanálise e Política. Pelas lógicas da sexuação de Jacques Lacan, depreendem-se lógicas da ordenação, que são duas: do Todo e do não-Todo. O político estruturado na lógica do Todo constitui um circuito que opera entre desejo de Ordem (O), ordens possíveis (o) e desordem e exceção (Oo). Na relação entre a Ordem e as ordens concretas (O-o), articulam-se desejo de Verdade, mito de origem, mito de ordenação e construções concretas sobre a realidade como algo consistente e coeso, numa mútua-afetação dialética com efeitos materiais concretos. Assim, historicamente, passamos de uma (i) Ordem fabricada, com mito de origem e ordenação cosmológico e teológico, para (ii) uma Ordem que deve ser humanamente fabricada, com mito de origem teológico e ordenação contratual; e, após, para (iii) uma Ordem que surge espontaneamente, onde compete ao Estado fabricar as condições da Ordem espontânea, com um mito de origem científico-evolucionista e de ordenação pelo mercado e costumes. Esses processos têm nuances políticas, econômicas, filosóficas e inconscientes. Como a relação entre Ordem e as ordens concretas (O-o) não fecha, há algo que sempre falta ou excede. Isso implica, por um lado, pensar a relação entre (des)ordem e Exceção na lógica do Todo, questionando a noção de normalidade, crise, inimigo e a relação entre Estado de Direito e estado de exceção. Por outro lado, permite compreender as maneiras e os efeitos de se posicionar diante da desordem: como ameaçadora (medo, inimigo) ou como produtiva (potência do fora, democracia como ingovernável, povo que se produz em ato, potencial criativo e inovador da pulsão de morte como o que resiste ao fechamento e move o processo de produção da vida). Direito, exceção, inimigo, fascismo e conservadorismo são subprodutos da lógica do Todo e da demanda de Ordem. Como lógica, está na forma como pensamos o mundo e, como somos parte dele, a nós mesmos. Também sustenta a forma como desejamos Ordem, Unidade, Identidade e Verdade. A lógica do Todo permite formas revolucionárias, eventos que produzem novos mitos e coordenadas. Mas é possível pensar uma dimensão para além, radical e subversiva, que busca não a reestruturação da Ordem por novos fundamentos, mas a superação de uma dada lógica. É o ultrapassamento da lógica do Todo para a do não-Todo. Palavras-chaves: Lógica do Todo. Lógica do não-todo. Ordem. Desordem. Exceção. Abstract: This thesis intends to discuss the logical foundation of the political through a dialogue between Law, Philosophy, Psychoanalysis and Politics. Through the logic of Jacques Lacan's sexuation, we can identify two logics of ordination: the whole and the non-whole. The political structured in the logic of the Whole constitutes a circuit that operates between the desire for Order (O), possible orders (o) and disorder and exception (O-o). In the relationship between the Order and the concrete orders (O-o) desire for Truth, myth of origin, myth of ordination and concrete constructions about reality are articulated as something consistent and cohesive, in a dialectical mutualaffectation with concrete material effects. Thus, historically, we have gone from (i) manufactured Order, with a cosmological and theological myth of origin and order, to (ii) an Order that must be humanly manufactured, with a theological myth of origin and political and contractual myth of order; and, later, for (iii) an Order that appears spontaneously, where it is up to the State to manufacture the conditions of the spontaneous Order, with a myth of scientific-evolutionary origin and of ordering by the market and customs. These processes have political, economic, philosophical and unconscious nuances. As the relationship between Order and concrete orders (O-o) does not close, there is something that is always missing or exceeds. This implies, on the one hand, thinking about the relationship between (dis) order and Exception in the logic of the Whole, questioning the notion of normality, crisis, enemy, and the relationship between the rule of law and the state of exception. On the other hand, it allows us to understand the ways and effects of positioning ourselves in the face of disorder: as threatening (fear, enemy) or as productive (power from outside, democracy as ungovernable, people that are produced in action, creative and innovative potential of the death drive as the one that resists closure and moves the process of producing life). Law, exception, enemy, fascism and conservatism are by-products of the logic of the Whole and the demand for Order. As a logic, it is in the way we think about the world and, as we are part of it, ourselves. It also supports the way we desire Order, Unity, Identity and Truth. The logic of the Whole allows for revolutionary forms, events that produce new myths and coordinates. But it is possible to think of a dimension that is beyond, radical and subversive, that seeks not to restructure the Order on new grounds, but to overcome a given logic.
