Discurso jurídico transgressional : feminicídio e combate à violência contra as transgeneridades

Abstract

Resumo : A transgeneridade e a Lei do Feminicídio analisados sob o viés do discurso do sexo biológico, gênero e da identidade de gênero. No decorrer de toda discussão proposta se procurou destacar a "Teoria Queer", trabalhada por Judith Butler e reforçada no Brasil por meio dos estudos de Guacira Lopes Louro, aliada a preocupação de deixar aberto o papel do Direito na construção de um conceito diferente sobre gênero, diferenciando-o da ideia de sexo biológico. Tal discussão ficou a cargo do direito penal e a consistência de uma nova interpretação no que tange a aplicação do feminicídio. Assim, faz-se uma apresentação dos modelos de identidade presentes em nossa sociedade, a qual trabalha somente com o feminino e masculino corporificados de maneira ideal, sendo tal percepção perpetuada pelo direito através da existência de discursos considerados dominantes. Fato que, por sua vez, permite a abertura de espaços para a violência cometida contra os corpos que não se adequam essa matriz epistemológica. Tem-se então que o primeiro capítulo trata sobre sexo, gênero e identidade de gênero, procurando desmitificar o tema à luz da teoria defendida por Guacira Lopes Louro, destacando ainda os índices de agressões cometidas contra mulheres trans e travestis, como resultado de um discurso dominante acerca do que compreenderia ser feminino. Já o segundo capítulo procura elencar o contexto de criação da Lei 13.104/2015, o modo como ela trabalha com a questão do sexo e não do gênero, e se seria possível, em consequência de um exercício de hermenêutica jurídica, estender a aplicação do respectivo dispositivo legal para as mulheres trans e travestis. Por último, procuramos relacionar o papel que tal hermenêutica teria na constituição de um discurso jurídico transgressional, aberto as experiências do fora.

Abstract: The discourse about biological sex, gender, gender identity, treated under the bias of transgenderity and the law of femicide, were the north for the creation of the present work. Throughout the proposed discussion, we sought to highlight the "Queer Theory", inaugurated by Judith Butler and brought to Brazil by the studies of Guacira Lopes Louro, allied with the concern of leaving open the role of law in the construction of a different concept about gender, differentiating it from the idea of biological sex. This discussion was in charge of criminal law and the consistency of a new interpretation regarding the application of femicide. Thus, we do a presentation of the identity models persistent in our society, which works only with the feminine and masculine ideally embodied, and law perpetuates this through the existence of discourses considered dominant. This allows opening spaces for violence committed against bodies that do not fit this "modus operandi". The first chapter deals with sex, gender and gender identity, seeking to demystify the theme in the light of the theory defended by Guacira Lopes Louro, highlighting the rates of aggression committed against trans woman and transvestites, as a result of a speech dominant about what we understand to be female. The second chapter seeks to list the context of creation of the Law 13.104 / 2015, the way it works with the issue of sex and not gender, and if it would be possible, as a result of an exercise of legal hermeneutics, to extend the application of the respective law for trans woman and transvestites. Finally, we try to relate the role that such hermeneutics would play in the constitution of a transgressional legal discourse, open to outside experiences.
