Uma análise da lei da alienação parental e sua utilização para manutenção de abusos psicológicos contra a mulher

Abstract

Resumo : Considerando que o Brasil ocupa o 5º lugar no ranking mundial de violência doméstica, o presente trabalho tem o objetivo de analisar a Lei de Alienação Parental após quase dez anos de sua vigência, a partir de uma ótica feminista, a fim de observar como a lei vem sendo interpretada ao longo dos anos e a sua efetividade no plano fático. Desta forma, o ponto chave da presente pesquisa é alertar e trazer uma visão pautada também pela ótica da mulher vítima de violência e na possibilidade da presente lei ser utilizada para perpetrar os abusos psicológicos ocorridos no âmbito familiar, quando a lei é usada de modo abusivo para dar continuidade à violência doméstica.

Abstract: Considering that Brazil occupies the 5th place in the world ranking of domestic violence, this paper aims to analyze the Parental Alienation Law after almost ten years of its existence, from a feminist perspective, in order to observe how the law has been interpreted over the years and its effectiveness in the phatic plane. Thus, the key point of this research is to alert and bring a view also guided by the perspective of women victims of violence and the possibility of this law to be used to perpetrate psychological abuse in the family, when the purpose of the law is misrepresented to continue domestic violence.
