Ativismo judicial em perspectiva : conceito, semântica e função

Abstract

Resumo : O presente trabalho explora o conceito de ativismo judicial, com a pretensão de expor a funcionalidade da qual ele pode e deveria se revestir no debate público e acadêmico sobre a qualidade da prestação jurisdicional, apesar da indeterminação semântica que o caracteriza. Para tanto, depois de esclarecer as circunstâncias nas quais o termo "ativismo judicial" se consolidou na história do pensamento jurídico, o texto se volta para alguns dos significados por ele compreendidos atualmente. A partir daí, são discutidos o avanço da jurisdição constitucional e o desenvolvimento da hermenêutica jurídica, no propósito de afastar as concepções de ativismo judicial incompatíveis com a realidade por meio deles delineada.

Abstract: The present work explores the concept of judicial activism, in order to underline the functionality it could and should carry on the public and academic debate about the quality of judicial provision, despite the semantic imprecision that speaks against it. Therefore, after clarifying the circumstances that explain how the term "judicial activism" became part of legal discussions, the article describes some of the meanings that it currently conveys. Thus, the advancement of constitutional jurisdiction and the development of judicial hermeneutics are discussed, with the purpose of challenging the conceptions of judicial activism that are incompatible with the reality outlined by them.
