A Farda e a toga - dois lados da mesma tragédia : uma etnografia da política e práticas do Sistema de Justiça Criminal (SJC)

Abstract

Resumo: Esta é uma etnografia sobre o Sistema de Justiça Criminal (SJC) realizada entre 2015 e 2018, cujo objetivo principal foi analisar o processo de interdependência dos campos do SJC, especificamente o judiciário estadual e a polícia militar. A observação participante dos rituais jurídicos de interação foi realizada em Ponta Grossa - Paraná, a partir das suas interações processuais e face a face nas audiências de instrução e julgamento e custódia, a partir da qual foi possível verificar os dispositivos estratégicos utilizados no processo de interpendência e agenciados nas práticas rotineiras do SJC. Pensado como um espaço de disputas (metacampo) entre instituições (campos) pela violencia legítima, e partir da análise sociohistórica e prosopográfica que visou mapear, definir e conceituar as instituições que compõem o SJC. Esse esforço foi concentrado na primeira parte da tese, na segunda parte, identificando na construção do inimigo social o núcleo fundante do SJC, proponho relizar uma arqueologia das relações de poder que lhe configuram e partir disso uma genealogia dos saberes articulados e inculcados no SJC e seus agentes. Na parte III e final da tese foi resultado da etnografia dos rituais jurídicos a partir da metáfora do teatro, no qual foi possível localizar dois dispositivos estratégicos de interpendência: A livre convicção e a (in)tolerância; ainda analisei o processo de interpendência e solidariedade entre os campos no compartilhamento de formas de classificação militarizadas cujo resultado verificável é a hipermilitarização. Abstract: This is an ethnography on the Criminal Justice System (SJC) conducted between 2015 and 2018, which main objective was to analyze the interdependence of the SJC' fields, specifically the state judiciary and military police. The active observation pertaining to legal rituals of interactions took place in Ponta Grossa - Paraná, henceforth their procedural interactions and face-to-face court and custody hearings, from which it was possible to verify the strategic mechanisms used in the process of inter-dependency and engaged in the routine practices of SJC. Thought as a space of disputes (metacampo) between institutions (fields) by way of legitimate violence, and start from sociohistorical and prosopographic analysis that aimed to map, define and conceptualize the institutions that make up the SJC. This effort was concentrated in the first part of the thesis, in the second part, identifying in the construction of the social enemy the founding nucleus of the SJC, I propose to establish an archeology of the relationship of power that configure it and from this a genealogy of the articulated knowledge inculcated in the SJC and their agents. Part III and final of the thesis was a result of the ethnography of legal rituals from the metaphor of the theater, in which it was possible to locate two strategic interdependence devices: Free conviction and (in) tolerance; I have also analyzed the process of interdependence and solidarity among the fields in the sharing of militarized forms of classification, which verifiable result is hypermilitarization.
