O judiciário como meio de controle de políticas públicas

Resumo: A Constituição Federal de 1988 inaugurou um novo estatuto para uma cidadania carente de direitos. Na euforia da constituinte, inseriu-se no texto constitucional inúmeros direitos que exigem a ação do Estado para serem implementados. O presente trabalho pretende fazer uma análise de como os tribunais brasileiros vem tratando essas disposições constitucionais verificando como as decisões judiciais afetam o processo legislativo municipal. A pesquisa envolveu, primeiramente, o que são políticas públicas. Chegou-se à conclusão que políticas públicas são ações intencionais de um governo que se encontram positivadas no ordenamento jurídico. Após, tentou-se descobrir quais seriam as políticas públicas municipais, ou seja, que ações os municípios prestam a população. Ao se analisar a produção legislativa de cinco cidades paranaenses constatou-se que grande parte das leis editadas tratam do orçamento público dos municípios. Em razão de considerarmos os atos normativos municipais como políticas públicas, fez-se necessário o levantamento de ADI's julgadas pelo órgão especial do TJ-PR. Foram levantadas 367 ações do período dos últimos cinco anos (2013-2017). Concluiu-se que os Tribunais de Justiça Estaduais são órgão competentes para controlar as políticas públicas municipais. Palavras-Chave: Políticas Públicas. Poder Judiciário. Controle de Constitucionalidade. Abstract: The 1988 Federal Constitution inaugurated a new statute for citizenship lacking rights. In the euphoria of the Constituent Assembly, many constitutional rights were included in the constitutional text that require State action to be implemented. The present work intends to make an analysis of how Brazilian courts have dealt with these constitutional provisions, verifying how judicial decisions affect the municipal legislative process. The study has come to the conclusion that public policies are intentional actions of a government that is put in the legal system. After that, we tried to find out what the municipal public policies would be, and what kind actions the municipalities do to their citizens. We analyze the legislative production of five municipalities of Paraná. It was verified that a great part of the edited laws are made to deal with the public budget of the municipalities. Because we consider the municipal normative acts as public policies, it was necessary to survey ADI's judged by the special court of the TJ-PR. 367 lawsuits were taken during the last five years (2013-2017). The major applicants were the municipal mayors, due to the invasion of their competence by the Municipal Legislative. It was concluded that the State Courts of Justice are competent body to control municipal public policies. Keywords: Public policy. Judiciary branch. Judicial review.
