dc.description.abstractResumo: O trabalho busca demonstrar que, embora a cidadania - ou o ideal cidadão -, ao longo do desenvolvimento do Direito Administrativo no Brasil tenha sido utilizada como reforço retórico para a viabilização dos poderes extroversos da Administração Pública, esta deve ocupar a posição de categoria fundamental de seu estudo, sendo, portanto, apta a irradiar juridicidade na estruturação dos institutos fundamentais da disciplina, ou seu núcleo duro. Nessa senda, o trabalho propõe teorizar o Direito Administrativo brasileiro para além dos valores exclusivamente jurídicos que majoritariamente o pautam, o que passa, necessariamente, pela investigação sobre os fundamentos da disciplina. Dado que o Estado contemporâneo difere, em muito, daquele modelo de Estado Liberal legado da Revolução Francesa, há que se questionar os porquês de o Direito Administrativo brasileiro ainda refletir, em muito, concepções que foram estruturadas nos seus primórdios, quando as relações objeto da disciplina eram, de fato, um tanto mais simples do que aquelas de que se encarrega o Estado nos dias de hoje. Para tanto, busca-se verificar em que medida o Direito Administrativo lança mão da noção de sudditanza (assujeitamento), própria do período anterior à sua instituição como disciplina, para viabilizar o desempenho de poderes extroversos pela Administração Pública. Neste sentido, a utilização da figura do administrado reflete bem o papel atribuído ao cidadão na relação jurídica de administração, qual seja, aquele de um objeto a ser tutelado. Na primeira parte do trabalho (Capítulo 1) propõe-se uma investigação histórica do conceito da cidadania e de seus valores, buscando-se averiguar como se dá, sob estas lentes, a compreensão da relação estabelecida entre Estado e cidadão, e quais as implicações que são decorrentes disso para a Administração Pública. Na segunda parte (Capítulo 2), inicialmente se analisa a conformação originária do Direito Administrativo, do surgimento da disciplina até sua inclusão nos cursos jurídicos brasileiros; após o que se passa a apreciar as obras de referência do Direito Administrativo, e o discurso nestas veiculado, acentuador dos poderes extroversos da Administração Pública. Com isso, a pesquisa centra-se, pela ordem, nas obras de Visconde do Uruguai (II Império), Alcides Cruz (República Velha), Themístocles Brandão Cavalcanti (Era Vargas), Hely Lopes Meirelles (Ditadura Militar) e Celso Antônio Bandeira de Mello (pós- Redemocratização). A terceira parte da obra (Capítulo 3) propõe-se a descortinar o viés cidadão do Direito Administrativo. Apresenta, assim, um diagnóstico do Direito Administrativo atual e uma crítica a alguns dos debates ora travados na disciplina. Concluindo que a cidadania e o ideal cidadão espraiam-se pelo Direito Administrativo, propõe-se uma reestruturação teórica da disciplina, nomeadamente por meio do respeito a interesses legítimos dos cidadãos e da progressiva imposição de deveres à Administração Pública, quais sejam, o de responsividade, o de transparência e o de accountability. Estes caracteres visam assegurar uma relação jurídica de administração conformada ao ideal cidadão e uma Administração Pública subserviente aos interesses da cidadania. dc.description.abstractAbstract: The thesis seeks to demonstrate that although the citizenship - or the citizen ideal -, throughout the development of Administrative Law in Brazil has been used as a rhetorical reinforcement for the viability of the extravagant powers of the Public Administration, it must occupy the position of fundamental category in its study, being therefore able to radiate juridicity in the structuring of the discipline's fundamental institutes, or its hard part. In this way, the work proposes to theorize the Brazilian Administrative Law surpassing the exclusively legal values that predominantly rule it, which necessarily goes through the investigation of the fundamentals of the discipline. As the contemporary State differs greatly from that model of the Liberal State bequeathed by the French Revolution, it is necessary to question the reasons why Brazilian Administrative Law still reflects, in many ways, conceptions that were structured in its beginnings, when the relations object of the discipline were, in fact, somewhat simpler than those of today's State. In order to do so, it is sought to verify the extent to which Administrative Law uses the notion of sudditanza (subjection), typical of the period prior to its institution as a discipline, to enable the performance of extravagant powers by the Public Administration. In this sense, the use of the figure of the administrated reflects the role assigned to the citizen in the legal relationship of administration, which is similar to an object to be protected. The first part of the thesis (Chapter 1) proposes a historical investigation of the concept of citizenship and its values, seeking to ascertain, under these lenses, the understanding of the relation established between State and citizen, in addition to what are the implications which are due to the Public Administration. The second part (Chapter 2) analyzes firstly the original conformation of Administrative Law, from the emergence of the discipline to its inclusion in Brazilian Law Schools; after, it proceeds to apprize the standard books dedicated to Brazilian Administrative Law and their statements, which emphasize the extravagant powers of the Public Administration. Thus, the research focuses, as follows, on the works of: Viscount of Uruguay (II Empire), Alcides Cruz (Old or First Republic), Themistocles Brandão Cavalcanti (Vargas Era), Hely Lopes Meirelles (Military Dictatorship) and Celso Antônio Bandeira de Mello (post-Redemocratization). The third part of the work (Chapter 3) proposes to uncover the Administrative Law's citizen bias. It presents, therefore, a diagnosis of current Administrative Law debates and criticizes some of them. Concluding that citizenship and the citizen ideal are spread by Administrative Law, it proposes a theoretical restructuring of the discipline, namely by respecting the legitimate interests of citizens and with the progressive imposition of duties to the Public Administration, particularly, that of responsiveness, transparency and accountability. These characteristics are intended to ensure a legal relationship of administration conformed to the citizen ideal and a Public Administration subservient to the interests of citizenship.
