dc.description.abstractResumo: O presente trabalho tem como objetivo investigar se e como, na prática jurisdicional, o Brasil reconhece o pluralismo jurídico, no tema de direito de família, para tentar contribuir com eventuais novas construções dogmáticas da Teoria do Direito, apropriadas a uma ordem jurídica plural e democrática. A problemática sobre a qual se desenvolveu o estudo é a inquietude de não desprezar, em razão do tratamento pluralista das normas, a necessidade de o direito se legitimar a partir do consenso da comunidade, de não renunciar a democraticidade das normas jurídicas. Uma sugestão para garantir legitimação democrática ao pluralismo jurídico é oferecida por António Manuel Hespanha e exige a soma de requisitos realísticos, escapando do pressuposto meramente formal. Buscou-se aqui aliar a discussão teórica sobre a legitimidade democrática para a criação do direito à investigação empírica acerca do primeiro requisito sugerido pelo autor: o reconhecimento de fontes normativas plurais (reconhecimento de quem diz o direito) por instâncias a quem a comunidade aprove o poder de reconhecer qual fonte é tida como direito (reconhecimento de quem diz o direito). dc.description.abstractAbstract: This paper aims to investigate if and how, in brazilian jurisdictional practice, there is a recognition of legal pluralism in family law, in an attempt to contribute to possible new dogmatic constructions of the Theory of Law, appropriate to a pluralistic and democratic legal order. The problematic on which the study was developed is the concern of not neglecting, due to the pluralistic treatment of norms, on one hand, the need for the right to legitimize itself from the consensus of the community, and, on the other hand, the need for not to renounce the democraticity of legal norms. One suggestion to guarantee democratic legitimacy to legal pluralism is offered by António Manuel Hespanha and requires the sum of realistic requirements, escaping from the formal presupposition. The intencion in this dissertation is to combine the theoretical discussion on democratic legitimacy for the creation of the right to empirical research on the first requirement suggested by the author: the recognition of plural normative sources (recognition of who says the right) by instances that the community approves of power to recognize which source is perceived as right (recognition of who says the right).
