(Con)formação da(s) identidade(s) da mulher no direito das famílias contemporâneo : perspectivas feministas sobre o individual e relacional em família

Abstract

Resumo: A presente dissertação tem como objetivo analisar criticamente as atuais transformações no Direito das Famílias, que se considera, diferentemente do passado, informado pelo equilíbrio entre a identidade-eu e a identidade-nós nas relações de conjugalidade e de parentalidade. Tais elementos constituem parte do significado da chamada concepção eudemonista, que é central neste estudo. Algumas conclusões aparentemente pacíficas são revisitadas a partir da condição feminina. Adota-se a perspectiva feminista, ao longo do trabalho, a fim de problematizar avanços. Para cumprir tal mister, promove-se a exposição de uma série de continuidades ainda vivenciadas por homens e mulheres na dialética entre individualidade e alteridade em família. Refletem-se, nesta oportunidade, em dados estatísticos e em vestígios da representação prevalente do feminino nos mais variados meios. Longe de negar relevância à atualizada compreensão da doutrina e da jurisprudência quanto aos papeis em família, intenciona-se contrastá-la às experiências reais, buscando discutir possibilidades de reaproximação. Paradoxalmente, a insistência em se refletir um ideal de igualdade de gênero nos enunciados jurídicos pode conduzir ao avesso da emancipação prometida às mulheres, a quem se possibilita precariamente o empoderamento pelos eixos patrimonial, relacional e individual. Constatadas as dissonâncias, emerge o desafio de se repensarem as relações familiares, do ponto de vista jurídico, de maneira mais adequada aos universos reais e simbólicos femininos. Abstract: The following dissertation’s objective is to critically analyze the current transformations in Family Law, which is considered, differently from the past, informed by the balance between "identity-I" and "identity-we" in parental and conjugal relations. Such elements constitute part of the meaning of the so-called eudemonistic conception, which is central in this study. Some apparently pacific conclusions are questioned from the feminine condition. The feminist perspective is adopted throughout the work to demystify advances. To fulfill such necessity, the exposition of a series of continuities still lived by men and women in the dialectic between individuality and alterity in family is promoted. They are reflected, in this opportunity, by statistical data and the vestiges of the prevalent representation of the feminine one in the most varied means. Far from denying relevance to the up-to-date understanding of doctrine and jurisprudence about the roles in the family, it is intended to contrast it with real experiences, seeking to discuss approaching possibilities. Paradoxically, the insistence in reflecting an ideal of gender equality in legal statements can lead to the reverse of the emancipation promised to women, to whom the empowerment through patrimonial, relational and individual axes is precariously enabled. Evidenced the dissonance, the challenge that the work explores is rethinking the familiar relations, from the legal point of view, in a more adequate manner to the feminine real and symbolic universes.
