Promoção dos direitos sociais na União Européia : o papel das instituições comunitárias.

Resumo: O objetivo central da dissertação é investigar a atenção conferida à questão social na experiência mais bem-sucedida de integração do mundo contemporâneo: a União Européia. Busca-se analisar o status atribuído aos direitos dos cidadãos dentro do bloco europeu. O problema a ser respondido é se os direitos sociais estão sendo atendidos e se as políticas sociais comunitárias estão sendo criadas dentro da União Européia. O trabalho verificará o espaço conferido ao cidadão e ao social no bloco europeu, a partir da investigação do processo decisório da UE e da dinâmica das suas instituições no âmbito social. Para tanto, será estudada a atuação da Comissão do Emprego e dos Assuntos Sociais do Parlamento Europeu, visto como o principal representante dos interesses dos cidadãos no bloco, e a participação da Comissão Européia e do Conselho Europeu na promoção de políticas sociais, a partir da análise dos documentos emitidos a partir de 1992 a 2011. Parte-se do pressuposto de que o cidadão é o foco central de um processo de integração e por isso, a promoção de políticas sociais deve ser um dos principais objetivos desse tipo de organização. A hipótese do estudo é de que existe um "déficit social" dentro da União Européia, ao se atribuir espaço limitado aos cidadãos e às questões sociais nas instituições comunitárias. O marco teórico utilizado foi o construtivismo aplicado às relações internacionais, o qual defende a análise das ações estatais a partir do estudo da construção social da identidade. As fontes consultadas foram os Tratados Constitutivos e os documentos emitidos no domínio social pelas instituições da União Européia, além de fontes secundárias especializadas no tema em questão. As conclusões obtidas foram de que os Estados evitam transferir soberania na área social para as instituições comunitárias, o que compromete a evolução de políticas sociais comuns, que concentram-se, sobretudo, na questão do emprego. Abstract: The main objective of the study is to investigate the attention given to the social issue in the most successful experience of integration in the contemporary world: the European Union. The work aims to analyze the status given to the rights of citizens in the European block. The question to be answered is if the social rights are being respected and the social policies are being created in the European Union. The work will verify the space given to the citizens and to social issues in the European Union, from the investigation of EU decision-making process and the dynamics of their institutions in the social area. For that, it will be studied the work of the Committee on Employment and Social Affairs of the European Parliament, considered the most representatives institutions of citizen.s interests in the block and the participation of the European Council and the European Comission on the promotion of the social policies,by the analysis of documents issued from 1992 to 2011. It starts from the assumption that the citizen is the central focus of an integration process and therefore the promotion of social policies should be one of the main important goals of this type of organization. The hypothesis of the study is that there is a "social deficit" in the European Union, by given limited space for the citizens and the social question in the communitarian institutions. The theoretical basis used is the constructivism of international relations, which defends that the analysis of state actions should be done from the study of the social construction of identity. The sources to be consulted will be the Constitutional Treaties and the documents issued in the social subject by the institutions of European Union, as well as books and articles from this specific area. The conclusions were that States avoid transferring sovereignty in the social area for the communitarian institutions, which hinders the development of common social policies, which primarily are focused on employment issue.
