A condição peculiar de ser adolescente desde um enfoque psicanalítico-social : uma reflexão sobre a negação dos seus direitos e a (des)legitimidade de sua responsabilização

Abstract

Resumo: A condição peculiar de pessoa em desenvolvimento, mais do que critério de interpretação e aplicação do sistema normativo de proteção à criança e ao adolescente, constitui fundamento dos direitos esses sujeitos, a ser considerado, especialmente, quando da responsabilização do adolescente que comete uma infração. Com o presente trabalho objetiva-se a abordagem da responsabilização do adolescente considerada essa peculiar condição, compreendida sob os aspectos psicanalítico, social, econômico, afetivo e cultural. Objetiva-se ainda verificar a responsabilidade da sociedade e do Estado na exclusão e marginalização desses adolescentes. Buscou-se, para essa análise, referência não apenas na criminologia – com a compreensão da infração a partir de um enfoque econômico, político, social – mas também nos conceitos psicanalíticos acerca dessa etapa de desenvolvimento humano,denominadaadolescência. Iniciou-se o trabalho explicando a condição de seradolescente a partir do enfoque psicanalítico, seguido pela contextualização histórica e sócio-econômica da responsabilização do adolescente e seus reflexos na construção da identidade do sujeito, finalizando com a proposta de uma reflexão acerca da esponsabilidade do Estado e da sociedade na exclusão dos adolescentes e a necessidade de uma atuação efetiva dessas instituições visando garantir os direitos e meios de vida adequados a esses dolescentes.

Abstract: The special condition of person in development, more of which criterion of interpretation and application of the prescriptive system of protection to the child and to the adolescent, constitutes basis of the rights of these subjects, being thought, specially, when of the punishment of the adolescent that it commits a breach. With the present work there at aims at the approach of the punishment of the adolescent considered this special condition understood under the psychoanalytic, social, economical affectionate and cultural aspects. There aims still to check the responsibility of the society and of the State in the exclusion and in the marginalizing of these adolescents. Reference was looked, for this analysis, not only in the criminology – with the understanding of the breach from an economical, political, social approach – but also in the psychoanalytic concepts about this stage of human development, called adolescence. The work began explaining to condition of being an adolescent from the psychoanalytic approach, followed the historical, economical and social context of the punishment of the adolescent and the reflexes in the construction of the identity of the subject, finishing with the proposal of a reflection about the responsibility of the State and of the society in the exclusion of the adolescents and the necessity of an effective acting of these institutions aiming to guarantee the rights and ways of life appropriate to these adolescents.
