O reconhecimento dos direitos autorais indígenas como forma de inclusão da diversidade no campo das artes

Resumo: Investiga-se a possibilidade da garantia de direitos autorais à arte indígena como forma de inclusão da diversidade no campo da arte. Como problema de discussão, busca-se verificar de que forma a interpretação sistemática da legislação brasileira, a partir da Constituição da República Federativa do Brasil de 1988, pode contribuir para a proteção autoral das artes indígenas, de modo a valorizar a representatividade da diversidade cultural brasileira e o seu patrimônio cultural imaterial. Justifica-se pela observação de que, conforme previsão constitucional, é dever do Estado proteger as manifestações das culturas indígenas, as quais são parte do patrimônio cultural brasileiro (Arts. 215 e 216). Percebe-se que há uma lacuna protetiva autoral das expressões culturais de povos tradicionais de viés coletivo. Observa-se também uma justificativa prática, a qual é verificada na existência de um debate contemporâneo sobre os direitos autorais das artes indígenas, enquanto se percebe maior participação dos sujeitos indígenas no campo das artes. De forma objetiva, analisam-se os direitos culturais, entre esses os direitos autorais, e suas dimensões de direitos humanos; as condições das autorias indígenas, a partir do reconhecimento da capacidade civil plena de seus sujeitos; os locais onde as artes indígenas se apresentam; o aparato normativo e as negociações existentes acerca dos direitos autorais indígenas; a hipótese de inclusão da diversidade na elaboração e interpretação de instrumentos de propriedade intelectual. Como metodologia de pesquisa, recorre-se a uma investigação teórica multidisciplinar, utilizando-se de análise normativa e de referenciais teóricos das ciências jurídicas em diálogo com as artes e outras ciências sociais. Privilegia-se, ademais, o olhar de sujeitos indígenas, buscando compreender lugares de fala, além do contexto teórico de sujeitos não indígenas, permitindo maior legitimidade e abertura a uma multiplicidade ontológica. Conclui-se que o reconhecimento dos direitos autorais indígenas é um dever do Estado ainda a conquistar e que ultrapassa a importância de instrumento de proteção intelectual ou de inclusão da diversidade no campo das artes, sendo um direito de valorização da existência, da participação cidadã e de inscrição e reinscrição da memória indígena. Abstract: This research investigates the possibility of guaranteeing copyright to indigenous art as a way of including diversity in the field of art. As a problem of discussion, it seeks to verify how the systematic interpretation of the Brazilian legislation, based on the Constitution of the Federative Republic of Brazil of 1988, can contribute to the copyright protection of indigenous arts, in order to value the representativeness of Brazilian cultural diversity and its intangible cultural heritage. It is justified by the observation that, according to the constitutional provision, it is the duty of the State to protect the manifestations of indigenous cultures, which are part of the Brazilian cultural heritage (Arts. 215 and 216). It can be seen that there is a protective gap in the authorial of the cultural expressions of traditional peoples with a collective bias. There is also a practical justification, which is verified in the existence of a contemporary debate on the copyright of indigenous arts, while there is a greater participation of indigenous subjects in the field of arts. Objectively, it seeks to analyze cultural rights, including copyright among them, and its human rights dimensions; indigenous authorial conditions, based on the recognition of the full civil capacity of their subjects; the places where indigenous arts are exhibited; the normative apparatus and the existing negotiations on indigenous copyrights; the hypothesis of including diversity in the drafting and interpretation of intellectual property instruments. As a research methodology, a multidisciplinary theoretical investigation is used, considering normative analysis and theoretical references from the legal sciences in dialogue with the arts and other social sciences. In addition, the gaze of indigenous subjects is privileged, seeking to understand places of speech, beyond the theoretical context of non-indigenous subjects, allowing greater legitimacy and openness to an ontological multiplicity. It is concluded that the recognition of indigenous copyrights is a duty of the State yet to be conquered and that it goes beyond the importance of an instrument of intellectual protection or inclusion of diversity in the field of arts, but it is a right of valuing existence, citizen participation and inscription and re-inscription of indigenous memory.
