E eu só tenho três casas : a do senhor, a da cadeia e o cemitério, crime e escravidão na Comarca de Castro 91853-1888)
Abstract
Resumo: O presente estudo aborda a questão dos crimes envolvendo escravos e libertos, na condição de vítimas ou réus, da região da Comarca de Castro, tendo por recorte temporal o espaço compreendido entre os anos de 1853 e 1888. A questão central articulou-se em torno das possíveis leituras do cotidiano possibilitadas pela análise dos processos-crimes e que acabaram por revelar como escravos, senhores de escravos, livres e libertos tensionavam suas realidades o tempo todo, por vezes conseguindo êxitos, por vezes, fracassando, mas sempre superando qualquer expressão de passividade frente a lei e as autoridades. Além de fragmentos do cotidiano, a documentação analisada revelou que mais do que preocupada com a criminalidade escrava,as autoridades e as partes arroladas nos processos preocupavam-se mais com a ameaça a sociedade pacífica e ordeira, com o desrespeito a lei e a ordem. O impacto das relações sociais se fazia tão presente nos julgamentos quanto às distinções jurídicas e as exceções já presentes na lei. Para atingir nossos objetivos analisaremos ainda o Código Criminal do Império (1830), o Código do Processo Criminal de 1ª Instância (1832) e as reformas de 1841 e 1871, os Relatórios dos Presidentes da Província do Paraná, as Atas da Câmara de Vereadores de Castro. Abstract: This study addresses the issue of crimes involving slaves and freedmen, as victims or defendants, the region's Castro District, with the time frame the space between the years 1853 and 1888. The central issue was articulated around the possible interpretations of everyday life made possible by the analysis of criminal proceedings and ultimately reveal how slaves, slave owners, free and liberated their realities tensed all the time, sometimes getting hits, sometimes failing, but always beat any expression of passivity in the face of law and the authorities. In addition to fragments of everyday life, the documentation reviewed revealed that more than slave worried about crime, the authorities and the parties enrolled in the processes concerned themselves more with the threat to orderly and peaceful society, with disrespect for law and order. The impact of social relations is so present in the judgments made about the legal distin tions and exceptions already in the law. To achieve our goals we will analyze further the Criminal Code of the Empire (1830), the Code of Criminal Procedure of 1st Instance (1832) and the reforms of 1841 and 1871, the reports of the Presidents of the Province of Parana, the minutes of City Council Castro.
