This thesis is a critical exploration of the processes whereby the legal subjectivity of migrants seeking refuge is constructed, based on qualitative research – exploratory analysis of specialized literature –, case studies and semi-structured interviews. The analysis of the conceptual elements and the legal workings takes into account the legal framework that regulates the request for recognition of refugee status as defined by Brazilian law, US law, and International Refugee Law. This theoreticalmethodological approach stems from the hypotheses formulated in the research project, which questioned the effectiveness of the abstract category of subject of law in guaranteeing the subjective rights of migrants seeking refuge. By contrasting this abstract category with the concrete circumstances of asylum seekers in the United States and Brazil, it is clear that this and other legal qualifications attributed to migrants are insufficient, and that there is a gap between the aims of protection and regulation contained in national legislation and in International Refugee Law. Sovereignty and nationality are central to this analysis, mainly as elements that disrupt the universal legal treatment presupposed in the formulation of the subject of law and in the construction of contemporary legal protection for refugees by International Refugee Law. Leaning on sovereignty and operating in a wide sphere of discretion, state agents interpret and apply legal rules, establishing migration policies and bureaucratic practices that hinder or prevent full protection for migrants and refugees. In these processes of continuous affirmation and denial of the binary national and non-national, belonging and not belonging, authorized and not authorized, the subjectivity described by personality rights, as the internal or moral sphere of the subject of law, is altered and reconfigured, marked by provisionality, instability and a narrowing of future horizons. The migrant seeking refuge is always legally defined as lacking rights, and their social condition is characterized by the absence of nationality, de facto and de jure. Lastly, the critique of the legal subjectivity of asylum seekers shows that overcoming the problems faced by these individuals requires transformations that go beyond the political configuration of contemporary national states
