Ações coletivas no direito comparado e nacional : uma tentativa de sistematização e análise crítica

Resumo: O presente trabalho objetivou estudar as ações coletivas no direito comparado e nacional, procurando desenvolver o estudo sistematizado e a análise crítica, com o escopo de formular proposições e sugestões destinadas ao aperfeiçoamento da prestação jurisdicional coletiva no Brasil. Para tanto, definiu-se diante da ação coletiva, enunciando o seu papel no contexto sóciojurídico do mundo contemporâneo. Para que a realidade nacional pudesse ser mais bem compreendida e analisada, fez-se o levantamento da evolução histórica e da situação atual da proteção judicial coletiva em onze países: Inglaterra, Estados Unidos, Itália, Alemanha, Portugal, Canadá, França, Espanha, Austrália, Argentina, Israel e China, bem como as sugestões formuladas pela Associação Ibero-americana de Direito Processual e as diretivas da Comunidade Européia em tomo do assunto. A ampla abordagem e diagnóstico das experiências sucedidas no exterior são com certeza inovadores e culminam com a elaboração de síntese e apresentação de conclusões relacionadas com o tratamento dado às ações coletivas no âmbito internacional. O quadro nacional foi em seguida detalhadamente apreciado, sob o prisma da evolução histórica das disposições normativas, dos interesses difusos, coletivos e individuais homogêneos, das regras de fixação da competência, da legitimação para agir e do equacionamento da litispendência e da coisa julgada, à luz da doutrina, dos tribunais e dos posicionamentos pessoais. Dentre as proposições sugeridas, destacam-se a introdução sistematizada da matéria no CPC, a atribuição de legitimação aos indivíduos, a caracterização da litispendência em razão do substituído e a adoção do sistema de exclusão, em termos de vinculação. Abstract: The present work aimed at study the collective actions in comparative and national law, seeking to develop a systematic study and a critical appraisal in order to formulate propositions and suggestions destined to the improvement of the collective jurisdictional guardianship in Brazil. Hence, it was defined facing the collective action, enunciating its role in the social juridical context of the contemporary world. To better comprehend and analyze national reality, it was taken in consideration the historical evolution and the current situation of the collective judicial protection in eleven countries: England, United States, Italy, Germany, Portugal, Canada, France, Spain, Australia, Argentina, Israel and China, as well as the suggestions made by the Ibero-American Association of Process Law and the guidelines of the European Community on the issue. The broad approach and diagnosis of the experiences happened abroad are, for sure, innovative and culminated with the elaboration of synthesis and presentation of conclusions related to the treatment given to the collective action in the international sphere. After that, the national framework was analyzed in details, taking in account the historical evolution of normative provisions of diffuse interests, of homogeneous collective and individual interests, of the rules to fix the competence, of the standing to sue and of the equation of pendency and res judicata, under the doctrine, the tribunals and personal opinions. Among the suggested propositions, it is emphasized the sistematic introduction of the matter in the Brazilian Civil Process Code, the attribution of standing to individuals, the characterization of the pendency due to the substituted and the adoption of the system of exclusion, in terms of connection.
