Judicialização da política do corte etário para o ingresso no ensino fundamental no Paraná

Resumo: Com a promulgação das leis 11.114/05 e 11.274/06 o ensino fundamental passou a ser obrigatório para as crianças com 6 anos de idade, aumentando 1 ano nesta etapa do ensino obrigatório e, portanto, totalizando 9 anos de duração. Segundo o Ministério de Educação, essa mudança tinha como intuito a ampliação do direito à educação, especialmente para crianças excluídas da escola pela não obrigatoriedade ou pela não existência de vagas suficientes na pré-escola. Com esta alteração, foi delegada aos sistemas de ensino autonomia para definir uma data de corte etário para o ingresso no ensino fundamental. No Paraná, o educando deveria completar 6 anos até 1º de março do ano letivo, fato este que ocasionou descontentamento por parte dos familiares, instituições privadas e Ministério Público, que ingressaram com ações judiciais, as quais obtiveram provimento, com raras exceções. Entretanto, ocorre que essas decisões vão em sentido contrário ao que foi proposto pelo legislativo e executivo federal. E desta incongruência, entre o que foi proposto em lei com regulamentações pelos conselhos de educação e o que foi decidido pelo Poder Judiciário, parte o objetivo geral deste trabalho: compreender o processo de judicialização da política de corte etário para o ingresso no ensino fundamental paranaense. Disto posto, elencam-se aqui os objetivos específicos: i) mapear os documentos jurídicos e normativos sobre o tema, como leis, ações no TJ/PR, ações coletivas no Brasil, decisões das Cortes Superiores e regulamentações dos conselhos nacional e paranaense de educação, bem como seus princípios norteadores. ii) compreender como o questionamento judicial de tal política se associa com as competências normativas estabelecidas para os conselhos de educação. iii) perquirir a necessidade do corte etário aos 6 anos de idade, como também de uma data-corte nacional. iv) trazer indicativos e elementos para a análise sobre qual entidade compete a normatização de tal corte etário e a quem caberia o papel de articular essa política entre os entes federativos efetivando o regime colaborativo. Para responder a esses objetivos, destacam-se duas categorias de análise principais para o recorte deste trabalho: a investigação do fenômeno da judicialização da educação, enquanto política pública e a relação entre a autonomia e a articulação dos conselhos de educação. Partindo disso, chegou-se no entendimento de que 63% das demandas judiciais eram de crianças provenientes da rede privada. Dessa forma, pode-se inferir que a judicialização da educação nesse caso adveio de um sujeito o qual o legislador não previu como destinatário principal. Por fim, verificou-se que a competência para regulamentar o corte etário é dos conselhos de educação, cada qual o seu sistema de ensino. E no intuito de articular tal política entre os sistemas, alvejando o cumprimento do regime de colaboração, nota-se o papel do CNE que deve buscar o equilíbrio entre a discricionariedade administrativa dos entes e a harmonia entre os sistemas para a consolidação do o Sistema Nacional de Educação. Abstract: The enactment of the law 11.114/05 and 11.274/06 made the elementary school compulsory for children with 6 years of age, increasing in this education stage one year and, thus, summing nine years in duration. According to the Ministry of Education, this change had the purpose to enlarge the right to education, especially for children excluded from school by the lack of vacancies in the kindergarten due to its non-compulsory provision. With this amendment, was delegated to the educational systems autonomy to set a date for age cut to join the elementary school. In Paraná, students should complete 6 years by March 1th, a fact that caused discontentment from families, private institutions and prosecutors, who filed lawsuits, which were granted, with rare exceptions. However, it turns out that those decisions goes in the opposite direction to what was proposed by the federal legislative and executive. From this incongruence, between what was proposed in law with regulations by the boards of education and what was decided by the Judiciary Power, follows the general objective of this work: understand the judicialization process of the policy of age-cutting to get into the elementary school in Paraná. That said, here ensues the specific objectives: i) mapping the legal documents on the subject, as laws, lawsuits in TJ/PR, Class actions in Brazil, Superior Courts decisions and regulations of national and Paraná boards of education as well as their guiding principles. ii) understand how the judicial dispute of this policy is associated with the normative competence established for the educational boards. iii) verify the necessity of a 6 years old age-cutting, as well as the need for a national age-cutting. iv) investigate which agency is competent to regulate this age-cutting, and to whom belongs the articulation role between federative unities in this policy, aiming to the effectiveness of the collaborative regime. To answer to these objectives, were highlighted two main categories of analysis for the approach of this work: the investigation of the phenomenon of judicialization of education as a public policy, and the relationship between autonomy and articulation of the education boards. From this, was reached the understanding that 63% of lawsuits were from children from the private schools. Thus, it can be inferred that the judicialization of education, in this case, stemmed from a subject which the legislature has not provided as the main recipient. Lastly, it was found that the competence to regulate the age-cutting is of the educational boards, each its education system. In order to articulate this policy among systems, targeting compliance of collaborative regime, was observed the role of CNE to seek a balance between the administrative discretion of the entities and the harmony among systems for the consolidation of the National Education System.
