Construção da legitimidade e potenciais democráticos : estudo da participação no processo decisório da Anatel (2010-2014)

Abstract

Resumo: As Agências Reguladoras no Brasil como se conhecem hoje foram implementadas nos anos 90, inseridas nos parâmetros da Constituição de 1988 que outorga um importante caráter participativo ao governo em todos os níveis. Neste contexto surgiram questionamentos sobre a legitimidade do poder decisório das Agências, sendo que os espaços de participação dentro das Agências - Consultas e Audiências Públicas - se apresentaram como um meio de construir legitimidade em torno do processo decisório destes órgãos. Esses questionamentos foram abordados neste trabalho em primeiro lugar identificando a relação entre participação e legitimidade a partir das propostas teóricas de Habermas, Rawls e Pateman, para adentrar no estudo das Agências desde uma perspectiva histórica a partir da qual se identifica o elemento de análise de controle popular, como potencial democrático vinculados à legitimidade. Estudou-se o nível de desenvolvimento desse potencial a partir da prática da participação. O estudo permitiu identificar problemas e críticas feitas desde uma visão mais teórica e de análise de documentos que foram relacionados com o controle popular. Posteriormente, em análise mais próxima à prática se analisou o caso da Agência Nacional de Telecomunicações (Anatel). Encontra-se no trabalho uma identificação das diferentes ações feitas pela Agência para melhorar a efetividade da participação no mecanismo de Consultas Públicas e em geral da prática participativa dentro da entidade. Abstract: The Regulatory Agencies in Brazil as we know it today were implemented in the 90s, inserted into the Constitution of the parameters 1988 granting an important participatory nature of the government at all levels. In this context emerged questions about the legitimacy of the decision-making of agencies, and the opportunities for participation within the agency - Public Consultations and Public Hearings - presented as a means to build legitimacy around the decision-making process of these government agencies. These questions were addressed in this study first identified the relationship between participation and legitimacy from the theoretical proposals of Habermas, Rawls and Pateman, to enter in the study of agencies from a historical perspective from which identified the element analysis of popular control, as democratic potential linked to legitimacy. We studied the potential of such development level from the practice of participation. The study identified problems and criticism from a more theoretical overview and analysis of documents that were related to the democratic powers. Subsequently, on closer analysis to the practice analyzed the case of the National Telecommunications Agency (Anatel). It is at work an identification of the various actions taken by the Agency to improve the effectiveness of participation in the mechanism of Public Consultations and generally participatory practice within the entity.
