Análise do processo de licenciamento ambiental municipal após a Lei Complementar 140/2011 : caso município de Aracaju / SE

Resumo: A Lei Complementar 140/2011 tem por objetivo fixar normas para a cooperação entre a União, os Estados, o Distrito Federal e os Municípios nas ações administrativas decorrentes do exercício da competência comum relativas à proteção das paisagens naturais notáveis, à proteção do meio ambiente, ao combate à poluição em qualquer de suas formas e à preservação das florestas, da fauna e da flora; e altera a Lei nº 6.938, de 31 de agosto de 1981. Desde a sua promulgação, mudanças vem sendo observadas quanto aos procedimentos do licenciamento ambiental, visto que, as atividades de baixo impacto poluidor passaram a ser licenciadas pelos órgãos municipais ambientais e não mais de forma supletiva pelo Estado. O Licenciamento Simplificado é um importante instrumento neste cenário, pois visa a celeridade e agilidade do processo. O município de Aracaju, capital do Estado de Sergipe, atendendo à legislação vigente, criou no ano de 2013, a Secretaria Municipal de Meio Ambiente, e em seguida, as condições necessárias para assumir tal responsabilidade, conforme prevê a LC 140/2011. A partir deste momento, a SEMA substituiu a ADEMA que atuava supletivamente ao licenciar as atividades que estão sob a responsabilidade municipal. É possível observar que o município de Aracaju, após a implantação do processo de licenciamento simplificado realizado pela SEMA, tem cumprido sua função enquanto órgão público gestor das atividades potencialmente poluidoras. O cumprimento das exigências e o aumento no número de licenças solicitadas/emitidas entre os anos de 2014 e 2015, respectivamente 259/257 e 904/802, evidencia que a SEMA cumpre satisfatoriamente a sua responsabilidade, segundo as definições da LC 140/2011. A dificuldade para implementação plena do licenciamento é a falta de apoio popular, fato este, que tem sido minimizado pela própria Secretaria por meio de fiscalização as empreendimentos e medidas relacionadas à educação ambiental. Abstract: The Complementary Law (CL) 140/2011 aims to establish the norms for cooperation between the Union, the States, the Federal District and the Municipalities in the administrative actions arising from the exercise of common competence regarding the protection of remarkable natural landscapes, the protection of the environment, the control of pollution of any type and the preservation of forests, fauna and flora; and amends Law 6.938, from August 31, 1981. Since its enactment, changes have been observed regarding the procedures of environmental licensing, given that low pollution impact activities started to be licensed by the municipal environmental agencies and no longer supplementary by the state. An important instrument in this scenario is the Simplified Licensing because it aims for a celery and agile process. The Aracaju municipality, capital of the state of Sergipe, with compliance with the current legislation, created in 2013 the Municipal Environmental Department (SEMA) and then the necessary conditions to assume such responsibility, as established by CL 140/2011. From this moment, SEMA substitutes the Environmental State Administration (ADEMA) that acted supplementary by licensing the activities under municipal responsibility. It is possible to observe that Aracaju, after the implementation of the Simplified Licensing by SEMA, has been fulfilling its function as public agency manager of potentially polluting activities. The compliance of the requirements and the increase in numbers of licenses requested/issued in the years of 2014 and 2015, respectively 259/257 and 904/802, show that SEMA fulfills its responsibility satisfactorily, according to the determinations of CL 140/2011. The obstacle for full implementation of the licensing process is the lack of popular support, a fact that has been minimized by SEMA itself through inspections of establishments and actions related to environmental education.
