Segurança jurídica no direito administrativo econômico : direito comparado e o setor elétrico brasileiro

Abstract

Resumo: A Segurança Jurídica volta aos debates após positivismo jurídico lhe impingir um identidade com o próprio sistema jurídico, marcadamente o sistema legal. Segundo Kelsen, esta "ilusão" da segurança jurídica é oriunda da tradicional teoria jurídica que, conscientemente ou não, esforça-se para perpetuá-la. A temática ganhou larga especulação nas últimas décadas, em especial, pela multiplicação e diversificação do direito e suas fontes. A lei, pura e simples, hoje não mais é garantia de direito. Por outro lado, a garantia de que o direito será observado também pode não passar pelo texto legal, mas deve ser função do Estado garantir esta aplicação normativa, sua conservação e breve, quase cirúrgico, aperfeiçoamento para garantir, acima de tudo, a segurança jurídica. A inflação legislativa trouxe ao mundo jurídico a mesma vontade de combater, tal como o fenômeno econômico, a quantidade perturbadora de leis. O trabalho transcorre, sem exaurir, alguns debatedores que se preocuparam com o tema: de Kelsen à Aarnio, de Hayek a Habermas. A propósito, Hayek dizia que a segurança jurídica não se configura nos casos que são solucionados pelos Tribunais, mas exatamente as situações que não são levadas aos julgadores é que configuram esta garantia estrutural da sociedade. Tão importante quanto à educação e a própria segurança pública, de difícil definição, assim como a "beleza" ou a "democracia", a Segurança Jurídica tem um efeito negativo: mitigar a multiplicação de leis, decisões e, principalmente, de corrida aos Tribunais, ou seja, pacificar a sociedade, fundamento primeiro do Direito. Para isto, gestores públicos, principalmente vinculados ao Poder Executivo, devem se profissionalizar, melhor planejar, garantindo a pacificação, não a turbando. Isto tende a se realisar com a profissionalização da função pública nos três poderes, mas deve se cristalizar com a participação da cidadania na formação das decisões. Faz-se breve análise do regime jurídico do Setor Elétrico Brasileiro - SEB, que passa por fase de judicialização de suas relações.

The legislative inflation, borrowed from economics designation, brought the legal world the same will to combat it, such as economic phenomenon, legislative inflation disrupts the dreams of lawyers, leaders, representatives, judges in general but especially the citizen. The work takes place, without exhausting, some debaters who worried about the theme of the Aarnio and Kelsen, Hayek and Habermas. Incidentally, Hayek said that legal certainty is not represented in the cases that are resolved by the courts, but the exact situations that are not taken to the Courts is contained in that structural warranty society. As important as eduction and public safety it, difficult to define, like "beauty" or "democracy", the Legal Certainty has a negative effect: mitigating the multiplication of laws, decisions, and especially race to the Courts, pacify society, first foundation of law. Public managers must become more professional to better plan this peace, assuring her, no disturbing or mobbing, is not what you see. This is only possible if the professionalization of the civil service in all three branches. At the end is a brief analysis of SEB, which undergoes a tumultuous judicialization phase of their contractual relations, hitherto in a fragile balance, but with "rules" clear the "game". These were changed unilaterally, bringing uncertainty as only certainty.
