Políticas públicas na tributação ambiental : instrumentos para o desenvolvimento da sociedade

Resumo: Diante do quadro alarmante em que se encontra o meio ambiente natural, é necessária a implementação de medidas ambientais de proteção. O homem habituou-se a utilizar o meio ambiente de uma forma insaciável, sem qualquer alocação de seu custo no processo produtivo, como se a natureza fosse infinita e gratuita. Uma mudança de perspectiva é necessária para a sobrevivência de vida humana no planeta. No Brasil, o Direito Tributário Ambiental ainda é campo pouco explorado, uma vez que tributos propriamente ecológicos quase não existem, mas o que se observa é a presença de alguns elementos tributários ecológicos em tributos que não são ecológicos e alguns instrumentos de Direito Financeiro, com a destinação específica do orçamento para a proteção ambiental. As normas tributárias indutoras, que modificam o comportamento, por meio do Direito Tributário, são instrumentos eficazes na proteção ambiental. Assim, há necessidade da implementação de uma reforma tributária ecológica, para a efetivação de políticas públicas com o objetivo de um maior desenvolvimento social, uma vez que pobreza e degradação ambiental são fatos que se interconectam. Quando se está no momento pré-jurídico, momento de elaboração da futura norma jurídica, importante observar algumas premissas, como a Ética, qual seja, a do cuidado ou ecológica, aliada aos pressupostos econômicos, em especial a Economia da natureza, que quantifica o meio ambiente. Para melhor adequação de uma política pública, é necessário que ela fermente em um ambiente de democracia participativa e com planejamentos factíveis. Já no momento jurídico, todo ele orientado pela Constituição Federal, adotando a sustentabilidade como matriz vinculante, observa-se a existência de princípios do Direito Ambiental e do Direito Tributário que dialogam entre si. Além disso, há a classificação dos tributos ecológicos e os elementos que integram a sua regra-matriz de incidência. Por fim, o trabalho foi dividido em três partes, um primeiro momento pré-jurídico, um segundo, jurídico, e um terceiro de síntese entre o primeiro e o segundo momentos. Neste último, escolheu-se o elemento natural água em razão da abundância existente no Brasil e da escassez de instrumentos jurídicos para a sua proteção. Apesar da sua fartura, a água é um recurso natural finito e que necessita de efetiva proteção, pois não há sobrevivência de vida no planeta sem ela. Abstract: In view of the alarming situation faced by the natural environment, environmental protection measures need to be implemented. Mankind has become accustomed to using the environment in an insatiable manner, without including any part of its cost in the production process, as if nature were infinite and free of charge. A change of perspective is needed in order to human life to survive in the planet. In Brazil, Environmental Taxation Law is, as yet, an almost unexplored field, given that truly ecological taxes virtually do not exist, but rather there are some ecological taxation elements in taxes that are not ecological and some Financial Law instruments specifically dedicated to the budget for environmental protection. Tax incentive rules, which modify behaviour through Taxation Law, are effective instruments for environmental protection. The need therefore exists to undertake an ecological taxation reform in order to make public policies effective and with the aim of achieving greater social development, given that poverty and environmental degradation are interlinked factors. When the future legal norm is being prepared and before it comes into force, it is important to abide by certain premises such as Ethics, namely the Ethics of care or ecological Ethics, allied to economic assumptions, especially the Economics of nature, which quantifies the environment. For public policy to be as adequate as possible, it needs to be fostered within a setting of participatory democracy and feasible planning. Following the legislative moment, which must be entirely guided by the Federal Constitution and take sustainability as its binding mainstay, the existence of the principles of Environmental Law and Taxation Law, which dialogue between themselves, must also be observed. Furthermore, there is also the classification of ecological taxes and the elements that form part of the rules as to when these taxes are due. Finally, this study has been divided into three parts, a pre-legal stage, a legal stage and a stage of synthesis between the first two stages. The natural element of water has been chosen in the last part because of its abundance in Brazil and the scarcity of legal protection instruments. Despite its abundance, water is a finite natural resource that needs effective protection, as life on the planet cannot survive without it.
