Direito fundamental à saúde : regime jurídico-constitucional, políticas públicas e controle judicial

Resumo: A positivação do direito à saúde como direito fundamental demanda uma profunda reflexão a respeito de suas repercussões jurídicas. Para construir, então, uma dogmática que seja adequada à compreensão daquele direito, o trabalho realiza inicialmente um resgate da teoria dos direitos fundamentais, explicitando que sua estrutura é multifuncional: a depender do caso concreto, o mesmo direito poderá exercer variadas funções. Ademais, pelo fato de a Constituição reconhecer-lhes aplicabilidade imediata, surgem do texto constitucional deveres que se impõem a todos os Poderes da República (dever de respeito, de proteção e de promoção). Apesar de possuir natureza principiológica, a própria Constituição e a legislação ordinária estabelecem parâmetros normativos que permitem definir seu conteúdo em situações concretas, restringindo dessa maneira a possibilidade de incidência das reservas que afetam os direitos fundamentais em geral. Na sequência, analisou-se a conformação constitucional da Administração Pública brasileira, bem como a relevância jurídica das políticas públicas como instrumento de agir administrativo apto a concretizar os objetivos constitucionais e o direito à saúde em especial. Nesse âmbito, merece destaque a análise do Sistema Único de Saúde, estrutura delineada pela Constituição para conduzir a formulação e execução das políticas sanitárias, que deverão observar as três diretrizes constitucionais do sistema: descentralização, atendimento integral e participação da comunidade. O trabalho verticalizou as questões centrais do sistema de saúde pública brasileira: o conteúdo da diretriz de atendimento integral, a estrutura de financiamento e a participação privada no SUS. No último capítulo foram abordadas as questões teóricas relativas à possibilidade de controle judicial do direito à saúde, bem como se realizou uma análise crítica da jurisprudência que vem sendo formada a partir de recentes decisões do Supremo Tribunal Federal. Ao final, foram brevemente analisadas algumas alternativas ao controle judicial que podem colaborar para um incremento no nível de concretização do direito. Abstract: The positivization of the right to health as a fundamental right requires a deep reflection about its legal repercussions. To build then an appropriate dogmatic understanding, the text initially addresses the theory of fundamental rights, explaining its multifunctional structure: depending on the case, the same right may exercise various functions. Moreover, because the Constitution recognizes their immediate applicability, arise from the constitutional text duties that ties all powers of the republic (duty of respect, protection and promotion). Despite having principle nature, the Constitution and ordinary legislation establish normative parameters that let the interpreter define its content in concrete situations, avoiding the incidence of the restrictions that affect fundamental rights in general. Further, the study analyzes the constitutional conformation of Brazilian Public Administration, as well as the legal significance of public policies as an administrative instrument able to achieve the constitutional goals. In this context, the research emphasizes the Brazilian National Health System (SUS), structure delineated by the Constitution to lead the formulation and implementation of health policies, which must observe the three constitutional guidelines of system: decentralization, integral care and community participation. The work analyzed the core issues of the Brazilian public health system: the content of the guideline of integral care, the financing structure and private participation in the SUS. In the last chapter were addressed theoretical questions concerning the possibility of judicial review of the right to health, as well as conducted a critical analysis of the jurisprudence that has been formed from recent decisions of the Supreme Court. At the end, were briefly examined some alternatives to judicial control which can contribute to increase the level of implementation of the right to health.
