Problemas estruturais do judiciário : por um processo civil factível

Resumo: A atual situação do Judiciário brasileiro é definida como crítica. Foram realizadas várias alterações na legislação processual civil para resolver seus problemas, como morosidade e inefetividade, mas falharam por duas razões: o mau uso da teoria da escolha racional e a desconsideração do acúmulo de processos desde a primeira instância. O diagnóstico esconde os reais efeitos dessas medidas (seu fracasso), fato e que não existem recursos materiais suficientes e que o sistema funciona exatamente conforme o planejado, já que ele prioriza a segurança ao invés da celeridade e da efetividade. Seus problemas são estruturais. Na verdade, não há crise alguma, e a crítica dessa perspectiva é feita em duas etapas ou dimensões. Primeiro, após a análise de duas acepções de "crise", percebe-se que ela nunca existiu, pois o udiciário sempre funcionou mal e nunca correspondeu às necessidades da sociedade. O falso diagnóstico, todavia, legitima as mencionadas alterações legislativas e desvia a atenção de problemas mais urgentes, como o acesso à justiça. Em segundo lugar, reforçando que os problemas do terceiro poder são estruturais, eles também são causados pelas metas utópicas que o processo persegue: a verdade, em sua oncepção "real" ou formal, relacionada a uma concepção particular de justiça. Os objetivos do sistema devem ser factíveis e elaborados com base nos ideais utópicos, sem jamais se confundir com eles. A actibilidade deve ser fundamento do processo. As metas sugeridas são centradas na prestação de tutela efetiva e seguem uma condição ética de factibilidade: a consideração das necessidades dos sujeitos. Um rocesso fundado na segurança atua como se as pessoas tivessem só preferências e não necessidades. A consagração dessas metas, que dão prioridade à celeridade e à efetividade, tem consequências, como a exequibilidade das decisões de primeiro grau e a garantia do acesso dos mais pobres à justiça. Abstract: The brazilian Judiciary current situation is diagnosed as critical. Several legislative changes have been made to try to solve its problems, as tardiness and ineffectiveness, but they have failed for two main reasons: the misuse of rational choice theory and the neglect of the accumulation of cases in the first instance. The diagnostic also covers up the results of these trials (their failure), the fact that the Judiciary does ot have enough resources and that the system may actually be working exactly as planned, since it prioritizes security instead of haste and effectiveness. Its problems are structural. Actually, there is no crisis at all and the critique of this analysis is done in two stages. First, after analyzing two notions of the idea it is perceptible that there has never been a crisis in the brazilian justice, for it has never been able to respond to the needs of the society. The wrong diagnostic, nevertheless, serves as justification of all the egislative modifications and deviates the attention from other urgent issues, such as the access to justice. Second, the malfunctioning of the Judiciary is a result of structural problems and the utopic goals that it pursues: truth, in its "real" or formal concepts, related to a particular notion of justice. The objectives of the system should be feasible and designed from the utopic ideals, without confounding with them. Feasibility should be a fundament of the due process. The suggested goals are centered in the effective protection of rights and comply with an ethical condition of feasibility: the regard of the subjects’ needs, which are not considered if the procedural system is based in security and treats people as if they had only preferences, not ecessities. The assumption of such goals, which prioritize haste and effectiveness, has consequences, such as the enforcement of first-degree decisions and the assurance of the nderprivileged access to justice.
